The sad fact of the matter is that in many ways, justice is a completely random process. The 3 appeals judges that ruled against Brady (by a 2-1 margin) were randomly selected.

I do not believe that they were randomly selected. The system is rigged. Goodell is a politician.

At least we'll probably know pretty soon. There have been at least some reports that Brady plans to file for a stay next week, and stay requests tend to be resolved pretty quickly (matter of days).

so if the court says no to a stay, then everything is over??

What are the chances if a stay is granted that the Supreme court can push the decision to hear the appeal until after the Super Bowl?

And can Brady decide to deny the Stay after it is granted?

I believe the Chief Justice has the power to schedule cases. He could move it to 2017 term if he felt a 9th justice were needed.

Brady has 90 days from yesterday to ask SCOTUS to hear the case, though I have been told that it's generally not too hard to get an extension. Then the NFL has 30 days to file a reply. Not counting extensions, that takes us to mid-November before SCOTUS even starts to think about it. According to a SCOTUS media guide they take an average of 6 weeks to make the hear/don't hear decision (that's just an average -- I don't know how variable it is). That would take things to the beginning of January. So if Brady could get a 30 day extension to file his petition (I have no idea how likely it is an extension of that length would be granted) that gets us to the Superbowl. So it is certainly possible.

Not sure what you mean by "can Brady decide to deny the stay after it's granted". I guess he could ask for the stay to be dissolved. No idea how likely that would be to be granted. My SWAG is that it probably would be.

that's the CA2 stay....not the application to ginsburg, i believe. wallach says that it won't get to her until mid-august.
 
What is even more astonishing is that they didn't even clarify their position to limit it The NFL CBA, so now any arbitrator can make up additional grounds for sanctions during an appeal hearing and get away with it.

Another ruling complete with a lack of thoughtfulness and disregard for precedence.

I would love to see the AFL CIO take a stand and reject arbitration as a method for resolving worker disputes and take every one to court.

I would love to see Patriot fans stage a walkout at the next game asswipe attends. We should start with a petition warning Kraft of this action if he allows that POS in the stadium but then it would be up to the season ticket holders to follow through.

I guess that starting with a petition of season ticket holders would be the first step. If anyone has any ideas on how to achieve this I would love to hear them. Maybe a Facebook page for season ticket holders could be the first step? Then try to get as many as possible to commit and send the team the results when they get to be significant enough.


The sight of 60 thousand plus fans turning their backs and walking out on Goodell would be a true thing of beauty.

I believe he only has 7 days to file the first request for a stay from CA2 so yes, I'm expecting that within the next week.

He has to ask CA2 for a stay before he can ask Ginsburg. As per Wallach, it is highly unlikely CA2 stays their own decision, but don't stress out about that. He has to get the procedural maneuver out of the way before going to Ginsburg, in whom our hopes lie.

I'd say the chances of that are decent, if that is what Brady's lawyers want. But if they don't get the stay, they probably will rush things instead of stall.

I'm pretty sure that yes, if Brady got a stay, he could nevertheless choose to serve the suspension.
 
From what ive heard, sounds like the SC would decide on whether or not to hear the case somewhere between late october-late november. If thats the case, i would bet the farm that TB will decide to serve the 4 game suspension at the start of the season, while still pursuing justice at the SC. hed do that because he wouldnt want to run the risk of the SC announcing in late nov. that they denied the request to hear the case. or worse, what if the SC doesnt decide until dec.? playoff run in jeopardy and the rest of the nfl gets what they wanted. i think the only way TB doesnt sit first 4 games is either SC makes their decision before game 1(highly unlikely), or his legal team tells him theres a high probability SC wont decide on whether or not to hear case until after the SB.(also seems unlikely). So if im a betting man, id make two wagers and go all in on both:1. TB is sitting out the first 4. 2. TB is still pursuing justice at the SC( but wont risk hurting the team by possibly facing 4 game suspenion in dec-jan-feb, when it matters.
 
It's really very simple and straightforward. Roger Goodell was the arbitrator for Brady's appeal and rather than either upholding our reversing the sanctions Brady was given based upon the grounds they were given on created new grounds for sanctions within that hearing. In other words he never ruled on the appeal and instead gave a punishment for grounds that weren't being appealed. That's clearly not the role of any arbitrator.
That's a very concise summary of what Olson and Feinberg argued.

At the end of the day an equipment violation was a ~$8500 fine.

Goody never served TB12 notice of the trumped up charges. That is a violation of the CBA.

How the laws of this land can allow this railroading to go unchecked is maddening.
I couldn't agree more, but unfortunately two Appellate Judges found that the NFLPA gave the Commissioner powers under the CBA that were broad enough to encompass such bad behavior and there wasn't a majority of Active Judges on CA2 who thought it was worth rehearing the case in light of that finding.
