Judge Berman order just filed on Brady: "Counsel and the parties are requested to engage in further good faith settlement efforts today."

Berman order on Brady: "I will meet briefly with counsel and the parties tomorrow morning at 10:30 for an update on your discussions."

---
I guess that means Goodell will say 4 games and smile this time.

The judge can say whatever he wants and he can punish whomever he wants. If Brady caves, all respect gone. If Brady is truly innocent (as most of us do) and accepts a punishment, then he can just go to work, help the team win and I will cheer for him on the field only.

No matter how much the judge huffs and puffs, if both sides refuse to come to a deal, IMHO he will have no choice but to issue a ruling which rewards one side and hurts the other.

To avoid confusion, here is the order:

In anticipation of tomorrow's conference, counsel and the parties are requested to engage in further good faith settlement efforts today. I will meet briefly with counsel and the parties tomorrow morning at 10:30 (in the robing room) for an update on your discussions.

It applies to both parties, not just Brady/the NFLPA. So it's a little misleading from Breer, but giving him the benefit of the doubt, I assume he was referring to "Brady" as the name of the case, not just the player himself.

he could also send the case to a nuetral arbiter

Its the judge requesting them to continue talking , not 'order' dramatic like breer sounds.

The disappointment here is that tomorrow will not be a public hearing.

These days I view everything that emanates from the NFLN with a jaundiced eye.

Would not surprise me if the editors "fed" Breer this headline so folks are to think that TB12 is not trying to settle with the NFL.

Tom should offer to pay a $50,000 fine as that is the precedent for not turning your phone over, and possibly maybe even go as high as $75,000 which is unheard of.

Goodell publicly saying he has no intention of lowering the suspension means any attempt at "good faith negotiations" would be a lie.

If brady gives even an inch, he comes off as a person at least trying to get this over with, and itll look better for him in the eyes of the judge, plus he'll make 100 times that back in the defamation suit.

The problem with offering a $50,000 fine is it sets a precedent that all future players will have to turn over their phones -- and its inconsistent with Gostkowski's lack of fine for the same offense.

"Good faith" from the league office? What a kidder! That judge is a laugh riot!

If I understand it correctly, that's just kicking the can down the road a little. I do not believe they can force a compromise so assuming both sides steadfastly refuse any compromise, sooner or later someone is going to make one side very happy and one side very mad.

I admit I may be mistaken. Not a lawyer or have any real knowledge of any of this.

A settlement would have minimal precedential value.

If I am Tom I don't entertain settlement talks that envolve #s of games. The only thing I would negotiate is alternative solutions other than a judge. ie an agreed apon arbitrator or to table it to next off-season after studying a years worth of ball pressure results from the new protocols. Or something like that. This shows the judge he tried to settle but allows him not to cave on his innocence.

Goodell probably offered the judge tickets to this coming year's Super Bowl.
