I heard Dale Arnold bring this up on his show today. Both those guys could go after the NFL and have a much lower standard of proof of defamation than Brady, Kraft, or the Pats because they are not public figures. Since they are private individuals, they do not have to prove malicious intent.

It would be their lawsuit that could hurt the NFL more than any potential lawsuit. It would be far harder for the NFL to get a suit from them thrown out on summary judgement.

I'd love to see it...this is where Kraft's actions could prove the words he wrote in response to the penalties: pay for their representation! Brady has the backing of the NFLPA and one of the best, if not the best, labor lawyer in the country on the case. McNally and Jastremski are two low-level employees railroaded by this investigation, their lives have been turned upside down and they've lost their jobs.

If Kraft truly believes there was no wrongdoing then hire them attorney's and let them fight this in court.

That would cost them both money they probably don't have unless someone does it pro bono. David v. Goliath.

IF they have a case they will have no problem finding someone to handle the case on a contingency basis, beyond winning a settlement the exposure would be great for the firm involved.

Interesting thought, they don't have a lot if dough but I'm sure plenty of lawyers would love a shot at the NFL.

I think there will be tons of reputable firms willing to do it on contingency. This lawsuit could get them millions if they win and contingency is typically 1/3 of the amount.

Yeah, it is tons of free advertising with their lawyers on ESPN and even CNN every night while the trial is going on. And if they win, they are the firm that helped the little guy take on and beat the billion dollar giant.

How about Kelly Naqi? She published his address after publishing a false report about wrongdoing. Would love to see her get sued.

I was wishing they could. I thought it would be a great chance to sue for wrongful dismissal. I was hoping that a big law firm would take them on as a Pro Bono case because it would be great publicity for the firm or that Brady would lend his team of lawyers to their cause. If they are found innocent then it means that Brady is completly innocent by inference.

Jastremski could have the best case. He turned in his phone to Wells and yet was still portrayed as a liar and cheater.

Yeah, McNally would definitely have a much tougher time because he did take the balls without permission and did go into the bathroom. He would have a tougher time in a defamation suit.

The only thing tying Jastremski to any of this is the text messages and they can be taken a number of ways and Wells has repeatedly said you have to take texts as 100% fact with no humor whatsoever.

The Pats are the ones that suspended McNally and Jastrewski, right? Even before the discipline came down from the league. And of course they were their employers.

That complicates things, I would think. First of all, it would make a wrongful termination suit harder. Second, while it sounds like it leaves defamation open, the Pats had all the information in the report and more, and so it's hard to see how the report could be construed as defamation leading to their dismissal.

Please tell me I'm wrong.

If they need money then they can get help with GoFundMe. The $1million GoFundMe to help pay for the fine is ridiculous as Kraft is a billionaire. $1 mil is nothing to him. But these 2 guys could sure use the cash if they plan on fighting.

I'm sure Brady might help them out as well. And Kraft might even help fund their legal fees if he truly believes they are innocent.

you know that gofundme campaign that was started to pay krafts bills? It Should be for these guys to pay for lawyers. Now thats something i would contribute to.

Not sure but to me couldn't Kraft claim he suspended based on the NELs statements, evidence, comments, and he was deceived by the fact that NFL defamed him?

I feel like somebody would take that case for free with the amount of potential money they could make.

Jastremski was extremely cooperative and yet his texts to his girlfriend were published in the report slandering him... I think he has a decent case. He will have a rough time getting a new job with everyone knowing him as the cheating Pats ball boy.

And don't forget McNally as "Houdini the pissing ball boy."
