I still don't understand this. If Brady didn't have anything to hide (which I believe he didn't) and knew the text records would essentially exonerate him completely why didn't he just cooperate? He had a chance to clear his name and just refused to do so for what reason? I can't think of a logical reason to not to allow the text records to be examined unless there was incriminating stuff in there and knew he was better off just refusing completely.

Can anyone explain why? I'm sure I'm missing something here and would like to hear someone to elaborate on his motive to not allow the text printouts to be processed. That's just the one thing here that doesn't click with me.

Brady DID cooperate.. Just because he never gave up control of his phone doesn't mean he didn't cooperate.. This idea that if he had given up control of his phone would have some how exonerated him is false thinking on your part..

It is the question that a couple of hundred million Americans are asking.

Perhaps Brady has given them the transcript of every communication asked for. In that case, the suspension will be overturned. If not, the question will stand, no matter what happens.

Brady is being suspended for not fully cooperating. Why shouldn't folks want to know in what way he didn't cooperate and why not?
======
Patriot fans simply don't care why. They simply don't want their team and quarterback attacked.

It is a question we discussed time and again in other threads. And your last two lines are ridiculous in that context.

This has been a scam and a witch hunt from the very beginning. Brady has been alternately hurt and pissed off by the crap from the beginning. He did cooperate but refused a request that was within his rights to refuse. For that he has been falsely (imho) accused and convicted by the league, and most definitely has taken a huge hit to his good name. Hope Mr. Kessler provides a bigger KO punch to the league than he ever has before.

fair enough

It has been discussed a lot.

I generally don't presume that folks have read all the posts in the 20 threads on a subject. I've been called out on that a few times over the years.

Who knows what he keeps on this phones as far as personal stuff about his wife and family. Picture this (and I am in no way saying this is the case). Imagine if the multi-cajillion dollar model wife sent him some personal and private photos that were on there somewhere?

Imagine the irreparable damage that would do to her reputation if that got LEAKED to TMZ? Would you turn over your phone in that situation to an agency that has already demonstrated a HUGE propensity on lack of information control (e.g. prior leaks)? Hell No… Even if it isn’t naked pictures of Gisle. Maybe it’s personal health information about his parents, etc…… There are any number of personal reasons that such a high profile person would want possibility of his personal business getting out, and none of which have anything to do with deflating footballs.
Yup. And we all know how the league office leaked like a sieve throughout Wells' "investigation."

No one is answering the question.

Apparently the answer is that in Brady's estimation the league didn't need the requested information so he didn't give it to them. The punishment for that is 0-4 games, depending on the appeal process.

Please demonstrate where the league has the right to suspend a player for not turning over something requested by Ted Wells, and then show the legal precedent that shows the leagues belief that they can do that could ever stand up in court.

If you want to know why Brady didn't cooperate with Wells, all you have to do is look at what happened to those that did. Take a look at Wells track record of creating meaning and explanation for text messages and ruling that his version is credible and the people who wrote and received them are lying.
If you would have your phone to that man under those circumstances I question your decision making.

For not cooperating by providing the information asked for, Brady has been suspended for not cooperating. We will all watch. I don't have a clue how Brady will convince a judge that there was significant damage to this good name.

I am not trying to single anyone out in particular but, can the instant gratification, ADD guys on here please shut up already. I mean last night it was Kraft the **** who diddnt hire a hit man only 2 hours after the punishment was read. Now we have people asking why Brady hasn't done a PC and proclaimed his innocence.

Everything has to be so "now" with some of you because you have no patience and obviously no idea on how you create strategy defending false accusations on a grand scale with a mob mentality public.
The Patriots have handled this as poorly as possible in terms of PR. The reason some teams can openly brag about overinflating footballs, or run trick formations, or take numerous PED's, or heat footballs on camera with no punishment or fanfare is because the mob believes the Patriots are cheaters. And the NFL reacts to the mob. They don't punish because of rule violation, they don't punish because of truth, they punish to quell the mob.

The world believes the Patriots are the biggest cheaters ever because of one made up rule that was violated, and one violation invented from thin air (pun intended). The poor handling of the first effected the second. Really, can you think of any team so famous for cheating? But plenty of teams have had blatant violations. Am I supposed to believe this is because they are so brilliant at PR? Because they know so much about how to handle media scrutiny? I can't imagine how they could have handled things any worse. The NFL convinced the world they deflated footballs without a shred of proof. While having evidence on their side the Patriots convinced nobody. Hell they even announced they would accept the penalty and suspended the accused. Something that makes them look completely guilty.

You can rationalize and say it would have made the court case less effective but it isn't true. They could always go to court. It's just they wouldn't have had to if they hadn't been so unabashedly submissive and obedient during accusations. Plus Kraft backed Goodell which highlights his poor judgement handling accusations through the years.

Does anyone have a link to the Q&A transcript from the call? I see tweets showing a transcript and I would like to read it.

I would imagine Giselle has probably instructed Brady many times in the past to always be vigilant of his phone and never let anyone he doesn't trust touch it. Not saying there's necessarily anything negative on it, but there could be many things on it that shouldn't be public - personal photos of Brady & Giselle, private conversations Brady may have had with others that are unrelated, personal contact information for powerful people, etc.

Brady could've easily said "You already have all the data you need, I don't see any reason to give you my electronic records. My testimony should be plenty."

Wells says today "he could've just given me his relevant texts and his word and that would have been fine." Hmm, considering his testimony was both labeled as a big fat lie and also completely omitted from the report, I would probably say Wells is full of s***.

Then you take a look at how Wells treated the records of Jastremski and McNally, and you can see Brady made a very, very, very wise choice. Also, considering he just hired Kessler as his attorney, I don't think he has anything to hide. He just didn't want Wells to have it. He will gladly give it to a judge.

I care why, and I don't want my team and QB attacked.

Donald Yee has explained this. Apparently you are in the Wells camp where when people give an explanation you ignore it and choose your own.

The issue the NFL now has to deal with:

They have, in effect, said that any NFL player must turn over his personal cell phone to the NFL when asked or face a suspension for failure to cooperate. This is not something that was agreed to in the CBA. NLFPA attorney Jeffrey Kessler is probably not going to just let that one slide by....

If the NFL tries to enforce this new policy, they will have to defend it, probably in court. If they don't want to defend it, they won't be able to enforce punishment based on it.

18 pages of entertainment and curiously, all I am looking forward to now is reading @Deus Irae pick legal holes through Ted Wells' conference call and the inevitable @Joker burn it all to the ground rant. Come on big guy...

Wells was lying/not being 100% accurate. He knows full well that he's not independent. He's represented the NFL in the concussion suit.

High profile attorney Ted Wells, who's represented former **** Cheney adviser I. Lewis "Scooter" Libby, among others, was observing Tuesday's arguments. Wells is one of the lead trial attorneys who will be representing the NFL should this case go to trial.

Not giving phone is not a punishable offense.

Gostkowski didn't give his phone either and no punishment there.

The phone issue with Brady is a faint. .

Brady was suspended for 'more than likely being generally aware of actions that more than likely occured', for not cooperating and for not being candid.
Cheater, liar, and didn't hand over phone.

Sorry if this has been discussed in depth before. My buddies were giving me crap about this today and I couldn't really give them a good answser.

I realize that polling shows millennials don't give a damn about privacy, and don't even really understand what it is. Most of the rest of us, however, consider it a very important right.

How many games did Gostkowski get suspended for not turning over his phone?

Ya know all of a sudden when thinking about wells Shakespeare who coined the phrase 'Thou doest protest to loudly' which is exactly what wells was doing. If Wells is so sure of his report and integrity why come out and proclaim his innocence so vehemently?
