Regarding the two instances of animals talking in the Bible, sure, I believe God could use an animal to communicate to us. I own a cat... when she meows at me, I know exactly what she wants when she does it. And that's just the cat on her own, communicating with her little pea brain! I'm sure the CREATOR of the cat knows her operating system well enough to accomplish a more advanced version of that. Would it be talking, per se? Or would He affect my hearing such that I could understand her better? Who knows.
If it was all a supernatural entity just controlling the snake, then the snake would not be guilty of doing anything on it's own. Why then did your God punish an innocent snake?

God gave us free will. He also gives his angels free will. Animals are different from humans. They don't have true free will. That said, we do not hold animals 'guilty' or 'not guilty'... just their masters. Dog kills someone? He is not charged with murder... the owner is. Even if the dog is put down, no one thinks the dog committed premeditated murder, unless they were trained to do so byt heir master. This snake's master was the great accuser, Satan. Hold him accountable.

Of course it would be moral to put the dog down, as in my argument above. The dog would represent a danger to other people, as would the snake. However, God only set new parameters for the snake's existence. He did NOT kill. Your question should be, "Why did God spare the snake's life? How could God show mercy to a snake?"
