Judge orders "good faith" settlement talks today

Berman doesn't want to solve a problem that's not his and shouldn't be wasting his time to begin with, if he needs to rule I think he's going to be pissed and treat both sides like stubborn kids.

I'm guessing he has most of his ruling written already.
 
Goodell probably offered the judge tickets to this coming year's Super Bowl. :mad:
Thats ok. TB12 offered backstage passes at the Victoria's Secret Fashion Show :p and free tickets to the "Cruise With Gronk" on February. How can any man resist that?

Of course Judge Berman is 71 so he'll need a EKG and a stress test before attending

He could and this would be the best case scenario because it would throw the entire process including the investigation, Brady's guilt or innocence and the Patriots guilt or innocence before a non-NFL arbitrator for thoughtful consideration. The only down side to Brady would be time, but the upside is huge, especially if he wants to go after principle by proving the case was a sham and not just get back the games. If Judge Berman has been paying attention and seeks justice, this will happen.
 
Well hopefully Berman's been watching because ****dell just said publicly the other day he isn't reducing it. So ****dell is already on record as having disregarding this order.

People keep saying this.
The judge did not ORDER anyone to give in anything.
The judge RECOMMENDED they try to negotiate.
While I recognize you may be using the terms interchangeably there is no ORDER FROM THE COURT being violated by either side saying they feel they are 100% in the right and will not accept less than what they want.
 
To avoid confusion, here is the order:

In anticipation of tomorrow's conference, counsel and the parties are requested to engage in further good faith settlement efforts today. I will meet briefly with counsel and the parties tomorrow morning at 10:30 (in the robing room) for an update on your discussions.

It applies to both parties, not just Brady/the NFLPA. So it's a little misleading from Breer, but giving him the benefit of the doubt, I assume he was referring to "Brady" as the name of the case, not just the player himself.

So there will NOT be anything public in court tomorrow.

He released the transcript that the NFL wanted hidden. The NFL and Goodell have been ripped nationally for their behavior. Berman understood how the appeal reanscript made the NFL looked, and exposed what a pos the Goodell 20 page ruling is.

He is putting the gun to the NFL's head.

Maybe he was wanting to see the NFL's reaction, assuming he really thought that far out about it.

If nothing else, there's been plenty of that.

I've thought of that scene too. :)

However, it's uncomfortably close to the other scene people referenced, in which Tom Hagen demands an apology from the Senate committee -- so far the analogy is good but it breaks down fast -- even though his client was totally guilty.
 
Tom should offer to pay a $50,000 fine as that is the precedent for not turning your phone over, and possibly maybe even go as high as $75,000 which is unheard of.

Goodell publicly saying he has no intention of lowering the suspension means any attempt at "good faith negotiations" would be a lie.

If brady gives even an inch, he comes off as a person at least trying to get this over with, and itll look better for him in the eyes of the judge, plus he'll make 100 times that back in the defamation suit.

Provided he holds a hard line and doesn't sign away his rights to a defamation suit in the settlement agreement, which WOULD be the normal thing to do.

Judges are very calculating, he knew EXACTLY, what he was doing.

Technically Goodell does not have to be bound in the Patriots matter by what the arbiter says in the Brady matter. However, it sure would jack up the pressure on him if the arbiter found there was no persuasive evidence of any wrongdoing ...
 
Considering this is from the same news agency that brought us "Brady wants the transcript sealed" and "Brady doesn't want to attend the hearing in person," I don't think Breer portraying it as the judge ordering Brady to talk settlement is an accident.

IIRC, some NFLN people have actually been independent in this matter. I forget who, however ...

Not necessarily. The settlement portions will absolutely be kept confidential. But Judge Berman could also have a conference or hearing on the record, which would be public.
 
I sat next to an attorney for the NFL on a flight Sunday. Seemed like a very nice guy until I brought this up (he must've known it was coming since I was wearing a Sox hat) then hE became super arrogant and insisted the Pats would lose in court and the full 4 games would stand.

Well, that's what he's supposed to say. :)
 
If I understand it correctly, that's just kicking the can down the road a little. I do not believe they can force a compromise so assuming both sides steadfastly refuse any compromise, sooner or later someone is going to make one side very happy and one side very mad.

I admit I may be mistaken. Not a lawyer or have any real knowledge of any of this.

More likely both sides will be a little pissed.
 
It's still crazy that this case is taking 6 months and is not resolved. This shows how incompetent the NFL and Roger have done handling this case. This is a witchhunt
 
Too many opinions. I'm so mad I almost don't care anymore. I support Brady and the Patriots players and coaches regardless of the outcome. I hate the NFL.
