The case will be heard in NY. MN judge orders it moved

I don't care where it is, as long as they get an impartial judge, one who looks at the facts, then that is all we can ask for. A fair and impartial judge....

I can assure you that the NFL did not file immediately in SDNY while the ink was still drying on the arbitration award to make sure a "fair and impartial" judge got the case.

This is what concerns me:

Richard M. Berman
Born 1943 (age 71–72)
New York City, New York, U.S.
Alma mater Cornell University
New York University School of Law
Fordham University

He has spent his whole life in NYC or at least Southern NY. If he's a Jets fan or even to a lesser extent a Giants fan, that's not good. It sounds silly that a federal judge would be influenced by such a thing, but I wouldn't count it out either.

I dont know. Anytime the NFL does something we think they are dumb and stupid. Get excited by responses by yee ,columns from stradley, well report context, wash post sally jenkins and NFLPA filings etc etc. But in the end everything has gone exactly how the NFL wanted. What has Brady's team or the Pats scored exactly till now ?Who is to say NFL is not powerful enough to have NY judges in their pocket.? The Judge even ordered a response by Aug 12th when the normal practice is 21 days from what I read. I hope things work out but feeling bummed this decision has been foregone by the corrupt NFL who has to win this case to save face as much as we can say NY court is not a bad situation

What about the "first to file correctly rule" or is that not a thing?

In theory, you're not supposed to be able to abuse this rule to preemptively screw a prospective plaintiff out of his venue choice (you know, what the NFL clearly just did). But it's the judge's call.

The NFL is not as dumb as every thinks. They have a lot of money and power to influence people that its scary.

Well, if that is the case, the NFLPA will file to have him recused for conflicts of interest.

If that's the case, he should recuse himself. Trust me, you don't want to make that application to a judge questioning his impartiality. The rest of the case is going to be a little . . . awkward after he denies it.

If goodell violated the cba as much as the nflpa contests than it shouldn't matter where the case is held.

Supposedly the judge is very liberal and pro worker

He can read and he's educated. That eliminates him from being a Jets fan...Giants fan don't hate the Pats and we all know why........
Back in 07' I attended both Pats games in the Meadowlands and it was a world of difference. Opening day versus Jets was Animal House with lowlife scum all around. Fast forward to week 17 and it was a polar opposite versus the Giants with joking and cordial atmosphere....

Not surprised. This is why Goodell filed first and in all fairness there was nothing the NFLPA could do to be prepared sooner because only the NFL knew when they would announce Goodell's decision and had their legal team on the courthouse steps that afternoon.

This will just add more legitimacy to a Brady/NFLPA victory when it takes place in Goodell's handpicked court. :)

Which still bothers me a little bit, Brady isn't really a lunchpail sorta guy, notwithstanding his work ethic.

I hate to say this folks, but the NFL just beat us in the game of "lawyerball."

I'd love to be wrong about that. I'm pretty sure, I'm not.

If he is fair and impartial and even pro labor why are you freaking out? If the above is true then we should feel fine for the moment.

Might as well have sent it to Indianapolis and let Polian and Grigson hear it.

Experience.

I've practiced law in the NY metro area (including SDNY) for over 15 years.

Arbitration award affirmed. That's my prediction. 101% certain (with a 1% margin of error).
