Who says that the courts tend to throw these labor complaints out? There isn't much precedent regarding a case like this.

Again people need to realize the court isn't looking at Tom Brady they are looking at a unionized worker being denied the right to make a living. The lack of evidence absolutely is a point the court will take up.

I disagree.

At it's very core, you have an employee who is potentially being denied wages because of the employer's claim that he did not adhere to a code of conduct.

The plaintiff's argument is that his employer has not substantiated their claim to justify the employee's right to earn his/her wages.

Yastrzemski and McNally were not NFL employees but Patriot employees. Their employer actually suspended both from their positions before the NFL asked them to? Perhaps, we now know why?
 
I always knew the Pats' preemptive suspension was done for some legal reason. I suspect the reason might be to keep their claim away from a labor dispute panel and have it heard in a court of law instead.
 
I firmly believe it was because immediately upon hearing that the Wells Report was going to be bad news Kraft panicked and suspended them in a preemptive attempt to get a more lenient punishment from the league.

Essentially he threw them under the bus and it backfired

I was referring specifically to TB12.

But as it pertains to McNally and Jaz, they certainly have options.

McNally is a part-time/hourly/seasonal employee. I can't comment on his employee agreement so I don't know if he waived anything

As I understand it, Jaz is a salaried employee- much different set of rights. Without knowing the details, he can petition his case with either the NLRB/USDoL or Mass Labor and Workforce & Development Office.

What I want to know is.....has he? If not, why?

so how do you think he would do if they brought him in to testify at brady's appeal hearing when there were 40 people in the room?

I wouldn't advocate that. My position is that the science explains the ball deflation, making texts, phone calls, ball bay testimony, bathroom breaks and other such distractions moot.

But ya I guess you could say technically 3 for 3 because a true independent arbitrator overturned it.

I mean goodell just looks bad off the bat when it goes to court and Brady's counsel argues about him not recusing himself because look at some of the last suspensions

Bountygate players- Stephen Burbank (Upheld)
Ray Rice- Former Judge Barbara Jones (Overturned)
Adrian Peterson- Harold Henderson (Upheld)
Greg Hardy- Harold Henderson (No Decision Yet)

How come goodell couldn't give it to another arbitrator, even Henderson who is clearly in the bag for goodell? Why not give it to Jones which would show the whole "not married to the report" and the report being independent.

Because Deflategate is about the Redemption of Czar Goodell and therefore he and he alone must preside over the inquisition of the Heretic Brady.
Goodell the valiant keeper of the Holy Shield will stand heroic over the prostrate heathen who has violated the sacred order of Parity far to long!
Brady must be vanquished from the realm of the NFL* that others more holy and ordinary may once again enjoy the rarefied air at the heights of NFL*s mighty bosom of Glory.
 
What exactly is it that has made Goodell uniquely responsible for the NFL's success? He has built on the success of others and there are other competent managers would would have done at least as well.

I think Roger the Dodger's real value to the 32 is his malleability. Tags was a Lawyer and thought like a Lawyer, Roger the Dodger has a marketing degree and thinks like a soap salesman. Tags had a set of principles which he learned in law school by which he operated and was held accountable by the Bar Association thus it was hard to manipulate Tags. Roger the Dodger is easily manipulated because he has been trained to sell soap and all sales people are buyers at heart. Plus there is no Bar Association to rein in marketers who are trained to tempt, lie and deceive to sell their products.
 
I wish the Wells report had come out back in February because we'd be in court by now. It's not like the NFL had to take until May to figure out what they were going to say, they knew back in January.

It took until may to fully assure the lynch mob was large enough and set in their thinking enough to swallow the load of crap the NFL* was going to serve up to them.
