His skills as an orator were apparent, also his skill at staying on point and making everything sound simple could prove useful to judges like Chen.
 
Olsen does bring up a good point. The odds of getting a hearing is a bit skewed because so many of the requests that get denied are not nearly as relevant and split by the judges who have heard the cases as this one is. You take away all the requests that had no shot going in, I bet the odds of getting a hearing is probably up to 30-40%.
 
His point about how the Cheif Justice of the 2nd circuit dissenting so infrequently fron his peers is what struck me as significant

olson said it in the interview linked above:
Fauria: So how important is having Katzmann, the one judge who disagreed--here's a guy that's the chief judge of that court--write his own opinion. I mean now, what does he have to do, go and basically convince his colleagues that he was right and they need to hear this?

Olson: Well, it is very important that the chief judge, Judge Katzmann, who's been on the court for many many many years, has participated in thousands of cases, he's highly respected, and he has dissented only 7 or 8 times in all of those years.

The next question is of the 7-8 in which he dissented, how many went to en banc and of those, how many were reversed.
 
He's dissented 7-8 times and they've approved an en banc hearing 7-8 times, I wonder if they're related.
 
NFLPA didnt expect the 2nd circuit hearing to go this much sideways. Yes they shouldve hired olson when clement was bought on but I dont think anyone expected chin or anyone to say there is overwhelming evidence and believe everything slandering NFL and clement filed in the briefs. The hearing itself was a shocker from what i have read.

Fauria actually asked that question, too, but Olson didn't know the numbers:

Olson: I don't know the answer to that, I should've checked myself. But it is very seldom, and to the extent that there are circumstances that are different in each of these cases, you have to take them one at a time.
 
Impressive.
I wouldn't want to try to win an argument with Olson that the sun was going to rise in the east tomorrow morning.

He might need to use smaller words so that Chen can understand him.
 
All we need is a day in court. Everything hinges on whether we can even see the judges or not.

I always thought that raw number was a tad bit silly, like displaying the NBA avg from the free throw line instead of Curry's when he gets to the line.
 
clement and olson have fought with NFL and NFLPA before I believe. And Clement won.
