The NFL desperately wants to avoid addressing the Pash point because directly addressing it will only bring the court's attention to Goodell's unexplained refusal to allow one party to the arbitration hearing any access to a key witness who directly oversaw the investigation against him. Better in their minds for that point to be deemphasized in the hopes that it ends up forgotten.

I see they are going with the predicted "Berman had no right to rule against us even though we are the one's that ran to his court to get it upheld"
It's annoying that the court can't actually rule on Rog's findings. The league will just keep fighting this because they don't get properly embarrassed.
