Judge orders "good faith" settlement talks today

I hope they/judge dont pressure brady to a 1 game suspension. The NFL has nothing to lose . Why do they care if brady gets 0 or 4. they want to save their ego and reputation . So if NFL offers 2 games does the judge tell brady to accept it ? Thats what is going to be interesting.

These days I view everything that emanates from the NFLN with a jaundiced eye.

Would not surprise me if the editors "fed" Breer this headline so folks are to think that TB12 is not trying to settle with the NFL.

Considering this is from the same news agency that brought us "Brady wants the transcript sealed" and "Brady doesn't want to attend the hearing in person," I don't think Breer portraying it as the judge ordering Brady to talk settlement is an accident.

Yeah Brady will walk in saying hey fine me X dollars. Goodell will walk in saying 2 games to show he is willing to bend some and neither side will agree but demonstrate they are willing to bend.

Here is, IMHO, the tricky part (this is all wild ass speculation and opinion):

This isn't a situation where, say, the parties are interested in money and a compromise can be reached. This is a situation where each side would honestly rather lose than settle.

Goodell would rather stand his ground and simply lose outright in court than be seen as caving. It's not like losing in court means Goodell himself has to pay a financial settlement. If Brady plays all 4 games, it's no skin off his nose.

And Brady would rather stand his ground and miss 4 games than admit wrongdoing because he knows he did nothing wrong. The suspension itself isn't as important as maintaining his honor.

I sat next to an attorney for the NFL on a flight Sunday. Seemed like a very nice guy until I brought this up (he must've known it was coming since I was wearing a Sox hat) then hE became super arrogant and insisted the Pats would lose in court and the full 4 games would stand.

Umm, the Pats aren't in court. Brady and the NFLPA are.

The Pats already lost thanks to our Dear Leader.

The Patriots turn seemingly rational people into mental patients. It's the dumbest thing I've ever seen.

You should have asked him how things went for the Saints and Peterson when they went to court. That would have shut him up quick.

The problem with offering a $50,000 fine is it sets a precedent that all future players will have to turn over their phones -- and its inconsistent with Gostkowski's lack of fine for the same offense.

That precedent was already set in the Favre investigation, and I think the NFLPA is willing to live with it. I really doubt the NFLPA is willing to die on the "we won't except even a token fine for noncooperation" hill; not when what they stand to gain is effectively neutering Goodell's unchecked 'arbitrator' powers in yet another venue. The more track record they establish in court for winning these things, the easier future cases should become.

That said, this is all dependent on Goodell not overcompensating for stupidity with raw aggression, so I doubt this will end up mattering. Goodell will insist on a four game suspension, and Berman will be forced to make a ruling.

The funny thing is it was a cross country flight and we were getting along just fine. He even added me on LinkedIn. By the time I went to show a colleague yesterday he had deleted me. And frankly the discussion was very cordial. Think he was VP of Player relations or something along those lines.

Doesn't this judge understand that the very reason they are in his court is because they CAN'T come to an agreement. That is why they are in his court...FFS!

Well hopefully Berman's been watching because ****dell just said publicly the other day he isn't reducing it. So ****dell is already on record as having disregarding this order.

What was the dude's name?

I anticipated more damning leaks from the NFL 24 hours from the meeting, but they just used Breer to put out stuff intimating Brady is not cooperating..

I expect more by the end of the day, despite being admonished by Berman the NFL will give out nefarious leaks to whatever pig is at the trough..

I think he understands very well.

In order for someone to appeal, there has to be reversible error in order to get a judgement overturned.

Berman's playing this one by the book, encouraging "good faith" negotiations, knowing damn well there's not going to be a settlement.

But if there's one thing a judge hates more than having their time wasted - it's having their rulings overturned on appeal.

Berman doesn't want to solve a problem that's not his and shouldn't be wasting his time to begin with, if he needs to rule I think he's going to be pissed and treat both sides like stubborn kids.
