NFL files its opening brief in Deflategate appeal.

It's the football season now.

The judges who are going to hear this Appeal won't even be named until January or February.

Just speaking for myself, I think I'm gonna wait until then to put any time or energy into thinking or worrying about this.

I'm on to Miami.
 
I get bored after trying to read more than about 10 words of these legal docs, but my understanding is that basically the NFL is sticking with their "Brady should be suspended just because we say so" argument.

Is that the gist of it?
 
Do kessler and co get to respond to this?
Wallach said the NFLPA deadline for their filling is in early December. Just like with the NFL, I kind of expect a lot of the same.
 
Can whoever hears the appeal also subpoena all halftime PSI measurements taken during cold weather games this year?

That will probably be the only way those measurements -- which will exonerate Brady -- see the light of day. It would also be hilarious if this dumb appeal blew up in the NFL's face.
 
I can't wait for the top-notch NFL legal team to make their arguments, which consist of:

- I'm Roger Goodell, and I can do whatever I want.
- The courts have no say in this matter, even though we invited the court by initiating the rulings and the appeal.
- WHARRGARBL
- BB cheated in 2007 by not following the letter we sent out that didn't really clarify our own rules which I haven't exactly read.
- My parents...I mean owners are going to kill me when they see the bill for this car wreck.
- Judge Berman was mean to us.

This is such a cluster**** of epic proportions. This makes the NHL look well-run.
 
Wait, someone clarify this for me. Are they now saying that all 4 of the Colts balls were within the legal range when measured even though that directly contradicts the Wells Report where 3 of them were specifically measured below 12.5? Is that the argument they are now making? Really?

Kessler better have a response ready to go tomorrow. I'm sure he knew this was all coming.
 
I think the tide has turned towards Brady within the media and I think they will go after Goddell bigtime for continuing this ********.
 
Also, NFL is asking CA2 to rule on all issues, including ones Berman did not consider.

I usually wait for Daniel Wallach or Steph Stradley to weigh in but yeah that seems to be the gist. It's exactly what Kessler predicted in his interview with Dale and Holley just before the season opener.
 
Yes, CA2 has the authority to rule on all issues. According to a lawprof friend of mine doing so is "disfavored", but they certainly have the legal authority to do so.
 


I believe the NFL opens the actual findings of the Wells-Pasch report to discussion by writing this in their brief, which means the CA2 could actually rule on Goodell's impartiality by questioning the gages used.
