Feely cannot testify. No new evidence allowed in appeals. Optics, however....

It's past 11am. Do you know where your lawyers are?

This Feely thing absolutely cannot be coincidental.

Feeling testifying is not evidence in relation to Brady. He is just speaking to precedent the NFL set in a previous violation. Kessler did speak to it in his briefing.

Anybody (Feely or Mara) could be asked questions in the private conference, though.

I believe that the judge can ask him questions if Feely agrees, but he can't be compelled to speak.

I can't remember if it was "A Few Good Men" or another court drama, but I keep thinking of the scene when the lawyer trotted in two pilots who were never going to testify, but were threatening all the same.

If Berman rules in Brady's favor, Pats haters will get touchy about Feely.
@ChoWZa I know the joke was pretty bad, but did it really deserve a dislike? Maybe Ian should implement a "not funny" rating. ;)

I think that is exactly it. I joked about Feely being Kessler's "Airman Rodriguez and Airman O'Malley" but the more I think about it, the more I think there's a bit of truth in that comparison.

So's hes there to testify that he didn't remember anything?:p

I will die laughing if Feely says, "Yep, I totally knew about the ball prep, too. NFL never even called me."

Maybe Kessler can say something like "I personally spoke to the Jets kicker and he said such and such". It would still be hearsay but having Feely there would give weight to the statement.

So is Feely Kessler's "trump card"?

Mara likely will not be nearly as stubborn as Godell, especially in a forum open to the public. That's what they pay Roger $40 for, to take the PR hits, which would lead to the conclusion if Mara has to answer for the NFL being unreasonable, why pay Godell?

This is the NYDN Fed Courthouse reporter:

Final push by both sides yields no settlement in#deflategate case. Berman to rule in next day or two.

haha, okay fair enough I used the undo-rating as my not funny button :)
