How on earth did this happen ? I hate the league right now...
 
I don't think they needed to be bribed or anything, if that's what you're implying. I think they're just ideologically anti-labor.

Liberalism (as the founding and prevailing ideology in the United States, not in the sense of American liberal vs. conservative) is inherently anti-labor because at its heart is the construction of private property, which allows for one person to extract profit based on the labor of another, so this isn't particularly surprising. That doesn't necessarily mean there haven't been pro-labor judges, because of course there have, but that people who work for a living and their legal representatives are generally fighting an uphill battle against a system designed to exploit them. Doesn't matter how little or how big your wage is, as Brady demonstrates.
 
May not be a terrible thing-- we get to see Grop and the team may end up rallying around this nonsense.
 
I agree with the Hillary part of your analysis. However, this is not a right wing/left wing, Republican/Democrat kind of issue. You'll note that the one dissenting appeals court judge was the sole Republican appointee on the panel.

The dissenting judge was a Clinton appointment.

Very sure. The CA2 panel said that since the undecided-by-Berman issues had been "fully briefed" it would go ahead and decide them. It decided them in favor of the NFL and then issued an order to Berman to enter a ruling confirming the arbitral award (i.e. the suspension). If Berman refused to do so the league would trivially be able to get a "do it, or else" order from the appellate court, or the appellate court may just enter the order itself.
 

This ruling is just part of the bigger picture.

We claim to be a nation governed by the rule of law and make an absolute mockery of it.

If you don't agree with the law, you just circumvent it.

The White House does whatever it wants.

The Congress does whatever it wants.

The candidates do whatever they want.

The NFL does whatever it wants.

Buy lawyers to pick the venues, judges, etc.
 
Speaking from a purely legal perspective about the appeal prospects of this case it should be appealed by Brady and deserved to be heard. When the head judge (i think of the entire 2nd court) is the dissenting voice that carries a lot of weight in a 2-1 decision. Also the case itself is important not for the Brady aspect (which us fans care about) but the legal aspects.

Can businesses simply force you to sign a document to work for them that gives away all legal rights and recourse without needing to be consistent or fair?

Are employers allowed to say "to work here you need to sign this with gives me permission to do pretty much anything i want for no reason". That is a case that matters a lot when it comes to bargain agreements and seeing how high profile this case it can be brought to the full 2nd circuit or supreme court and not be out of place.

Just like it doesn't matter when a CEO runs his company into the ground, or uses the company's cash hoard to buyback stock 50% above its current stock price, etc.

Does anyone know if forfeiting is even possible? I know it would never happen but man a last minute forfeit of the Arizona game would be ****ing amazing.

The court decision today should tell us why it would be the stupidest decision in the history of professional sports to try a stunt like a forfeit.
 
I'm honestly so tired of this crap that I just can't be that emotional. I have faith in Jimmy G to win at least 2 out of 4 games, maybe more - and when TB12 comes back it will be total scorched earth on the league.

Pretty much sums up how I feel.
 
Brady and this team had a chance to stick it to goodell and his cronies and came up short. Now brady's gonna be 39 and likely will miss 4 games to start the season. I feel like ****dell got the last laugh here.

Don't be too sure. CA2 has only granted en banc review in something like 8 cases in 11 years. Also, I read an article that said unlike many other circuits, panel judges circulate their draft opinions to the entire circuit during the decision-writing process, the express point being to limit any perceived need for en banc review since the other judges would have gotten their oar in along the way.

Especially since the league has to pay Goodell $150mil if they fire him (it's in Roger's contract).

As pissed off as I am both are very likely if Brady decides he has had enough of this ********. And if Garrapolo plays well his value skyrockets after the season and a first rounder will be the requirement not the hope.

Although I still want Brady to keep fighting I would be fine with him holding a press conference where he denies any wrongdoing and lambastes Goodell and says he is filing a huge defamation suit.
 
Don't read Ian Gunn (@IanPGunn) | Twitter because you'll only get more enraged as Gunn points out how the majority blatantly misunderstood multiple facts and arguments in the case.

Also eff the NFL I want Gordon even more now because he may hate the league more than Brady and thats what I want I want bad guys who hit guys when their down cuss when the camera is nearby push refs and ignore their media and uniform requests.


Me personally I'm not sure about what Berman's options are or about any of this legal stuff, I'm just angry.

We do have a few lawyers on the board tho that I'm hoping weigh in
