What does the CBA say about turning over phone?

Can we keep it to just this question: was Brady acting within confines of the CBA in refusing to turn over his phone?

He might have been acting within rights negotiated between the NFL and NFLPA, but such a statement does not, to the best of my knowledge, appear in the CBA itself (I just searched for "communication," "device," "email/e-mail," and "phone," and found no such comments).

My understanding is that this is covered by the negotiated CBA not allowing subpoena power by the league.

Can you search 'subpoena' or 'investigation'?

The NFL has no "subpoena" power. So they had no right to demand the cellphone in the first place. Which means making that one of the rationales for docking Brady 4 games is an exercise in false logic.

The NFL boot-lickers have come out in force in favor of Ted Wells’ claim that Tom Brady did not properly cooperate in his investigation of low-pressure footballs used by the Patriots in the first half of the AFC title game.

The issue was Brady’s unwillingness to turn over a personal cell phone and e-mails from a private account to Wells. The boot-lickers have joined the cry that Wells and the NFL have a full right to engage in such invasions of personal property in investigating the conduct of club employees and players. …

“If he doesn’t have anything to hide, why would he not turn over the texts and e-mails?” has been the din from the house organs and much of the anti-Patriots public.

Real simple: Privacy.

That’s why you don’t use a cell phone issued by an employer. That’s why you pay $100 a month – or in Brady’s case, presumably much more for security – for your own cell phone.

Other than a request from police in a criminal matter, or a subpoena, it’s no one’s gol-darn business what is on a private cell phone or e-mail account. Wells and the NFL don’t have subpoena power, so Brady was fully righteous in telling those parties to take a hike.

It is preposterous the NFL now can make the fascist-like leap that Brady can receive extra punishment for not providing Wells with private texts or e-mails.

So clearly it was a tactic by Wells to muddy the waters for Brady. He knows he wasn't going to give up the phone and didn't want him to so he could cling to "well he didn't give up his phone, so he must be guilty"

Because if there was any text from Brady to anyone of those people that had anything to do with PSI it would have been in there.

Thanks for posting. Were those texts retrieved from TB12s phone or the recipients?

My understanding was that TB12 did not give up his records as Wells and Yee could not agree on scope. Accurate?

I hope to god this is true and that Brady's agent can prove it.

Or the leaks have started again, and they say they have them all, thinking this way Brady wont delete and texts.

I heard that Tom Brady made his phone available to look through during the interview, but did not turn it over for forensic analysis.

It probably just means they had access to the Patriot company phones, which we already knew. Wells wanted the texts to his mom and other things to slander like he did with the other guys.

The truth is likely....
Wells: "We want your phone, you can trust us to keep the non football stuff private"
Brady/Yee: "here's all the texts related to football. No way you get the private stuff, not with the sieve that is Park Ave NFL HQ".....

Can you imagine what the value would be for TMZ and similar sites for intimate email exchanges between Brady and his wife? 7 figures. No way he's going to trust the NFL with that.
