The more I dig in to it, I think you have something. RICO can also be filed by an individual who has been wronged and filed as a tort rather than a crime. One of the predicate (underlying )offenses allowed is fraud. If Brady could show that they met the elements for fraud as well as for RICO, he could potentially have something.... I wonder if suing them individually and NOT as members of the NFL because they were acted outside the scope of their employment would be allowed..
Any legal minds care to opine????
I need to dig into it but Goodell is the lead of an organization that committed fraud. Plain and simple.
 
Well I'm meaning mouthpieces need to be fired. I agree the media is having somewhat of a shakeup. It's because their reporters aren't doing their jobs anymore. I use Volin as a prime example of why print media is failing. He can do no better of a job than you or I right now. None. That's unacceptable. He should be let go. Also, where are the investigative reporters? It's a different thing to take a document and report on it. To get sources to talk and root out the actual story is something totally different.


Volin wouldn't even be in Boston if papers will still doing well. Guys like Reiss have fled the medium, because it's a sinking ship, where they would have hung around to become the next generation of McDonoughs and the like, in better newspaper days. With the younger generations having the attention spans of ******ed gnats, papers, like books, are ending up as casualties

I took it as Roger being the Piper and with his lies (magical flute) lead all his cronies ( children) and other followers to their demise.

As long as Roger is on the losing end, I'll like it. haha

Shame that good guys like Reiss and Bruschi are stuck working for scumbags like ESPN.
Not that I tune into ESPN too often, but haven't heard boo from Bruschi, via that medium. Guess they want to keep him sidelined until they need to talk Pats.
 
Even Reiss hasn't commented on Mort since that day. I wonder if ESPN has ordered a blackout.
 
So the judge is allowed to force re arbitration or he can just rule if the punishments are wrong and life the punishment ? Seems like the judge wouldnt want want this to linger in another arbitration heading to court again later , right ? Or maybe that is/should be the settlement play from the NFLPA.?

As discussed in other threads, judges don't want to make ANY rulings, because they want the parties to settle instead.

And if the parties can't agree on a final disposition, than the alternative is a neutral arbitrator, with specified timing, ground rules, whatever. The parties can agree on THAT, or they can let the judge pick the details, with the latter course probably being more hassle for all concerned.

Two possible sticking points:

1. Brady will want Wells, Pash, et al. to waive attorney/client privilege.
2. The league might want to torture Brady by making the timing as disruptive as possible to his season.
 
Anytime I get in argument with someone over this and they argue with false information so I correct them they always go back to the "deflator" texts, sad thing is I also hear lots of national shows using that also. Pretty sad 1 man's unfortunate use of a word has caused so many to assume guilt and not look at any other facts.

I was thinking about the "deflator" text and I get the argument that it's a silly explanation. The thing is, it's not impossible that he could have honestly meant it for weight loss. It's not extremely common, but there are enough weight loss sites that use the term that it's possible that he was telling the truth.

If he had called himself "Mr. 11.5" instead and the explanation was that he was trying to get in better shape and reduce his body fat percentage to 11.5%, I don't think anyone would believe that. The deflate/weight loss explanation, though, people don't have to like it and people may not hear that very often, but it's not an impossible explanation.

The haters like to laugh at the notion that it refers to weight loss. However, in the context in which it was used, it actually makes more sense that it refers to weight loss than to air pressure.

"Deflate and give someone that jacket" doesn't make sense if we are talking about air pressure.

I honestly think it is just a case of buddies using workplace vernacular as a sort of code in ways that don't really make sense to you and me but are an inside joke to them.

I believe reiss made comments about how the league let the bad info linger so long, without naming Mort. He is one of the few at that network who has criticized the league.

You are right. Reiss has avoided doscussing ESPN's culpability for failing to retract the false report. The reason is likely the same reason Most has not done so.

But these morons discovered the texts after talking to them 4 times. How about preparing properly before grilling these 2 bozos. Any attorney who is good should be able to get these 2 talk if they did something if he did his job correctly.
Considering the pash emails etc Iam sure the pats felt the league investigation was reaching to find a reason to find them guilty.

The jacket was broken down extensively .It was made during the GB packers game. This is like the spygate tapes were never seen when it was shown to the entire media with the SD cheerleaders on it.

Mort isn't retracting an error.
Reiss isn't contradicting his colleague's reporting.

Those are closely related, but they aren't exactly the same thing, so they probably also don't have exactly the same reason.

It wouldn't surprise me in the least if he is on a standing order to go nowhere near this beyond speculating.

He knows how deep this runs.

The comments to that article are, for the most part, amazing. Seems like 95% of NFL fans are on our side now. (Skewed though, in the kind of people who read this article in the first place)
