FOXBORO, MA -- While the Patriots started off the 2004 season with a victory on Thursday night, one Patriots fan's family wasn't quite as fortunate.

The Providence Journal reported on Friday that Michael E. McCarthy, 27, from Middletown was struck and killed by an SUV near Gillette Stadium following New England's 27-24 win over the Colts.

According to State Police McCarthy was walking north alongside the southbound lanes of Route 1 when he was struck by a SUV driven by David Gray, 57, of Norfolk at around 12:30am.

He was reportedly pronounced dead at the scene early Friday morning.

The crash is apparently under investigation; and no charges have reportedly been filed against Gray.
