Default Drug testing for HGH discussed

Will the players agree to HGH testing? - NFL - Yahoo! Sports

If the players resist due to their right to privacy and the owners won't open their books due to their right to privacy, then isn't the issue the right to privacy?

No. Apples and oranges. The owner is the employer, and has every right to keep his books private.

Drug testing is both a workplace safety issue, as well as a means to ensure that a player doesn't use an unfair advantage against other players through artificial performance-enhancement. Although I dislike the idea of drug testing on 4th amendment issues, the courts of ruled it may be used as a condition of employment under workplace safety considerations.

However, HGH should NOT be illegal for a player to use under a doctor's orders when rehabilitating an injury. It shouldn't be banned, but placed on a "doctor-mandated" schedule of drugs allowable under certain conditions.

Nice post. Covers it all.

I read that it may just be put out there for the players union to fight against, and one extra thing the owners could "give" the union in exchange for other CBA issues. I wonder if it will be in the final CBA.

So if your calf hurts really bad on Monday, you get to take HGH but if it is just a bit sore, you are subject to a 4 game ban?

I've half jokingly said that the Players should have to open THEIR books as well!

I know they think the NFL owners are not spending or sharing their money wisely enough... but let's be realistic about the amount of Bling $$$ blown by NFL stars and all the crazy ways they blow their money!

What's good for the goose should be good for the gander.

Full disclosure from the NFLPA!!!

Did you read the part about "under a doctor's orders?"

If a doctor deems it important for rehabilitation, then it ought to be permitted if prescribed. You take it on your own, however, and yeah... suspension time.

I think the point is that doctors have a lot of latitude in what they prescribe and to who and in what quantity. I think we all know someone, maybe themselves, a friend or a family member, that has gone to get a second or third medical opinion searching for the diagnosis or medication that they want. It's really not that hard. It's not illegal, its not unusual and its a direct result of the complicity of practicing medicine and differing opinions.

when you are under a contractual agreement to share a percentage of income, why shouldn't the owners open the books? it looks like a hollywood movie that is a smash but somehow all the money is gone for those wondering where the profit went. more power to the players if they can expose sham accounting.

And if you do not know a crooked doctor the guy at the next locker might.
