OK, havnt we already gone over this? the accident is not quite clear cut
yea stallworth had alcohol in his blood over the legal limit, but the right quesiton is how much did that affect the accident
fact is, there is a possibility that even without ANY alcohol the accedent may have still occured, which means the pedestrian was as fault as well
the fact that stallworth had been drinking only complicates the matter

You can't know this. No one can. Stallworth might have blown .262 and the guy might not have died. Butterfly's wings and all. Doesn't discount the fact that driving under the influence is as dangerous as carrying a loaded weapon in the waistband of your sweatpants (maybe more dangerous). That alone means it should never be considered a "tragic accident" and more of a criminal act.
But this has all been covered ad nauseam here and other places. There are some who believe as I do and some who believe that drinking and driving is no big deal, minds will never be changed unless something major happens to that person. I just hope I never "run into" any of the other camp when I am driving.

If the man who was killed was a relative to ANY of you and you loved him then you know damn well you would have a different opinion of Donte's drinking while slightly impaired than you do now because in reality none of you care about that dead guy who you didn't know.
Lets not BS here and say "I still would have thought Donte didn't do much wrong" if you knew the dead man.
I still wonder if MY own accident was not the reason of an impaired driver myself,will never know

We don't know how Stallworth would have reacted had he been completely sober.
I'm sure you've experienced situations where you've had to take evasive maneuvers to avoid getting into an accident because another driver/or pedestrian wasn't paying attention. Had he not been drinking, he may have been aware of what was around him.
Put it this way, if Stallworth was some random guy driving around over the alcohol legal limit and he kills a little kid who runs out into the street, I think your stance would be different.

Anyone who has ever driven on 395 where this accident happenened sympathizes with Stallworth. The Peter King story is the first place I've seen it described accurately - it is a six lane highway. Have you ever seen someone run across 128? I don't remember ever seeing it in the 20 years I lived up there and I don't care to speculate on how I might react if it happened, especially if it happened in the dark. Fact is, we don't know if the accident could've been avoided if he hadn't been drinking, but every aspect of his behavior post-accident makes me want to give him the benefit of the doubt.

don't pre-judge
stallworth did what so many, many people in our society do on a regular basis (including myself)
he is not a murdering scumbag, but he had an extremely bad lapse in judgement that cost someone else their life. did alcohol play a part? it doesn't really matter in my opinion except that it is how the law is written.
if that had happened to me, or to the average private citizen on a 1st DUI, I duobt any of us would have done time.
I still classify the event as an 'accident' and something that has plenty of room to be litigated for in civil court.
I don't feel bad for him in any way......he deserves to live with the guilt he has......that said, I don't think of him any differently as a person......for me as well as most of us, that woudl be hypocritical
