Default I Could See Al Davis Potentially Doing This......

If I'm reading this correctly, once the Patriots traded Seymour's contract and rights to the Raiders and it was approved by the league office, he is now an Oakland Raider. The only thing that would nullify the trade would be his failing a physical...
What if Al Davis in one of his lucid moments decides that he made a bad trade and tells his team physician to flunk Seymour regardless if he were to pass or not? He could set the bar for passing so high that no one could pass...Ignoring the ethical or legal implications for the physician of making a false report, can't you see Al Davis potentially doing this to undo what he may perceive as a bad deal????
Does it then go to the commissioner to decide whether the Raiders acted in bad faith or do they get an independent examination and arbitration????
This thing just keeps getting weirder and weirder....

The easiest way for the Raiders to have the deal voided is to get Al a physical and have him declared dead.

There are loopholes to everything and you just pointed out one of them. If Seymour refuses to report, this deal will go dead. In addition, Schefter is starting to see the light that Seymour has more leverage than people think.

That would be very easy to disprove. There has to be a diagnosed reason for the failed physical and all NE has to do is ask for it to be reviewed by a 3rd party.

Any doctor caught doing this would be costing themselves a lot of money, so this plan has that going against it as well.

Al can't do anything. Seymour is an Oakland Raider. Maybe he will trade him back for a 7th round pick?

That wouldn't be inline with his leaked trade chart cheat sheet:

QUESTION) Are the raiders willing to trade a 1st round draft pick for one year of service by Seymour?

If the answer is yes, Seymour has some, but not much leverage if he doesn't report. After all, the raiders can put him on the reserve list and wait for his services in 2010 or 2011 whenever Seymour is ready to report. In the meantime, Seymour makes no money.

If Seymour does sign, then he does have a bit of leverage. As a RAIDER, he can sit out, with the prescribed penalties. As I recall from the Samuel and previous Seymour holdoff discussions, he can sit out several games before being subject to the reserve list.

==========
BOTTOM LINE
If Seymour takes the physical he has leverage with the raiders. If not, he has does not UNLESS the raiders refuse to wait a year and void the contract in which case Seymour will likely play for pioli.

The key is know what is in the mind of Al Davis. No wonder the media is having difficulty sorting this out.

I don't think so...a 5 day letter will go out and if he does not report..he will NOT play this year, will get no money and this year on his contract will be voided, thus, he will not be a free agent until the end of 10. I really do NOT think he wants to do that...too much about the money.
