Blackmon was arrested in 2010 in Texas driving back to Oklahoma from Dallas after a MNF game between the Cowboys and Giants.

Wow...2nd DUI in a 2-year period, and this one "aggravated" (i.e. nothing borderline here, he was seriously drunk). And he has not yet signed a contract.

That's going to cost him. I imagine his contract will prominently feature some language regarding his off-field contract and tie his compensation to good behavior.

Would this mean that he is not officially an NFL employee and not subject to fines and/or penalties? I don't know if the league office differentiates between when the crime was committed and when sentencing occurs as with Dennard.
