{"id":6522,"date":"2016-06-01T08:42:22","date_gmt":"2016-06-01T12:42:22","guid":{"rendered":"http:\/\/www.patsfans.com\/patriots\/blog\/?p=6522"},"modified":"2016-06-01T08:42:22","modified_gmt":"2016-06-01T12:42:22","slug":"wednesday-daily-rundown-61-new-england-patriots-news-notes","status":"publish","type":"post","link":"https:\/\/www.patsfans.com\/patriots\/blog\/2016\/06\/01\/wednesday-daily-rundown-61-new-england-patriots-news-notes\/","title":{"rendered":"Wednesday Daily Rundown 6\/1: New England Patriots News and Notes"},"content":{"rendered":"<p>A quiet morning on this Wednesday, but here&#8217;s a quick rundown of this morning&#8217;s top stories.<\/p>\n<p><strong>Brady Gets Some Help<\/strong> &#8211;\u00a0Patriots quarterback Tom Brady got a little help last week from a group of independent scientists as well as\u00a0Robert Kraft, with both filing &#8220;friend of the court&#8221; briefs in an effort to bolster Brady&#8217;s shot at getting a rehearing in front of the U.S. Second Court of Appeals. \u00a0However, Tuesday a report came out that saw a key player step forward and file a brief that could hopefully tip the scale and get Brady&#8217;s case back in front of the judges.<\/p>\n<p>According to reports, the AFL-CIO joined the case, with the Federation of Labor Organizations filing a brief that certainly hits home with what&#8217;s transpired over the last year-plus.<\/p>\n<p>The brief leads off with a key point as it pertains to collective bargaining agreements with discipline, and feels Roger Goodell didn&#8217;t fairly\u00a0handle the arbitration process.<\/p>\n<p>&#8220;The AFL-CIO is a federation of 57 national and international labor\u00a0organizations representing approximately 12.2 million working men and women,&#8221;\u00a0the brief, prepared by attorney James Coppess, stated. \u00a0&#8220;Most collective bargaining agreements negotiated by AFL-CIO-affiliated unions\u00a0contain arbitration provisions to resolve disputes over the meaning of the contract,\u00a0including with regard to discipline. As a result, the AFL-CIO has extensive\u00a0experience with the operation of arbitration procedures in the disciplinary setting\u00a0and a significant interest in the application of the proper standard for judicial\u00a0review of decisions rendered pursuant to arbitration procedures.&#8221;<\/p>\n<p>From there, the brief gets right to the point and immediately points out what most of us already know, which was this whole procedure was never fair and Brady never had a shot at a proper arbitration hearing, which &#8211; like most of us obviously feel about the entire investigation &#8211; was never neutral.<\/p>\n<p>&#8220;Because the\u00a0Commissioner \u2013 who issued the discipline to Brady in the first instance \u2013\u00a0failed to follow basic procedural fairness and acted arbitrarily as an\u00a0employer seeking to justify his own disciplinary decision rather than as a\u00a0neutral arbitrator considering an appeal \u2013 his decision should be vacated,&#8221; the brief stated.<\/p>\n<p>&#8220;While the NFL and NFLPA bargained to allow the Commissioner to hear\u00a0appeals of disciplinary decisions, they did not agree to let the Commissioner,\u00a0sitting as an appellate arbitrator, to act in a manner that is arbitrary and\u00a0capricious. Regardless of who hears appeals, labor arbitration always must\u00a0be fundamentally fair.&#8221;<\/p>\n<p>&#8220;Fundamentally fair&#8221; is hardly how anyone would describe what&#8217;s gone on. \u00a0In fact, the brief goes on to point out one key fact that &#8220;rather than limiting his review to his initial<br \/>\nrationale for the discipline,&#8221; the Commissioner &#8220;instead \u201cchanged the factual basis for the<br \/>\ndisciplinary action after the appeal hearing concluded.\u201d \u00a0From there Goodell,\u00a0&#8220;rather than engage with this issue to test &#8216;the correctness of [the\u00a0discipline]&#8217; based &#8216;upon the reason given at the time,&#8217;\u00a0the Commissioner \u201cattempted to strengthen the employer&#8217;s\u00a0defense.\u201d<\/p>\n<p>Obviously when a key labor organization can see the obvious, that should hopefully be enough to give Brady another shot at beating this thing. \u00a0It backs attorney Ted Olson&#8217;s argument about the fact this ruling goes well beyond football, and now places even more importance on the outcome of the case given the precedent it will obviously set.<\/p>\n<p>This whole thing hasn&#8217;t been fair since it started, and seeing anyone lose in a situation where they never had a fair chance is always frustrating. \u00a0A decision on whether or not\u00a0the Second Circuit will rehear the case will reportedly be made\u00a0the end of June. \u00a0Most experts, including SI.com and UNH Professor Michael McCann, thought it would be a long-shot that Brady would get that chance.<\/p>\n<p>After Tuesday, things are certainly a little more encouraging.<\/p>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"10\">\n<tbody>\n<tr>\n<td><img decoding=\"async\" src=\"http:\/\/www.patsfans.com\/images\/us-presswire\/600w\/2014-Week-14-Tom-Brady-Fired-Up-PreGame-600w.jpg\" width=\"100%\" \/><br \/>\n<strong>Another player threw their hat into the ring in support of Brady this week.<\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Butler To Show Up at Patriots OTAs &#8211; <\/strong>Jeff Howe of the Boston Herald reported on Tuesday that Patriots defensive back Malcolm Butler will be at OTAs this week, despite Mike Reiss&#8217; report about the fact he&#8217;s unhappy about his contract.<\/p>\n<p>According to Howe, Butler&#8217;s absence last week had nothing to do with his current contract situation.<\/p>\n<p>&#8220;The Herald was given a strong indication Butler&#8217;s absence last week was not related to his contract,&#8221; Howe <a href=\"http:\/\/www.bostonherald.com\/sports\/patriots\/the_blitz\/2016\/05\/source_malcolm_butler_expected_to_attend_patriots_otas_this_week?utm_campaign=bostonherald_trending_stories&amp;utm_source=bostonherald&amp;utm_medium=trending_stories\" target=\"_blank\"><strong>wrote on Tuesday<\/strong><\/a>. &#8220;Furthermore, Butler doesn&#8217;t want to draw any added, unnecessary attention to himself this offseason, particularly as it relates to his contract, after last offseason when he missed a flight and reported late for OTAs.&#8221;<\/p>\n<table border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"10\">\n<tbody>\n<tr>\n<td><img decoding=\"async\" src=\"http:\/\/www.patsfans.com\/images\/us-presswire\/600w\/2015-AFC-Divisional-Malcolm-Butler-DpkLJ-600w.jpg\" width=\"100%\" \/><br \/>\n<strong>Malcolm Butler will be at the OTAs this week and Jeff Howe from the Boston Herald is reporting that his absence last week had nothing to do with his contract situation. (USA TODAY Images)<\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Having Butler back at work is obviously a big key as now is the time to start building some continuity among some of the new players who will be in the locker room this season. \u00a0After the Patriots finish these\u00a0final practices, they&#8217;ll break one last time before training camp starts next month.<\/p>\n<p>With Butler back in the fold, that will certainly help shift the focus back to where it should be, with\u00a0Butler seeing if he can&#8217;t help get his team back to playing at a championship level one more time.<\/p>\n<p><strong>Jets See Decker and Marshall Return &#8211; <\/strong>If you&#8217;ve been following the disaster going on down in New York, their situation finally settled down a bit this week.<\/p>\n<p>After skipping workouts in support of quarterback Ryan Fitzpatrick, Eric Decker and Brandon Marshall were back at\u00a0voluntary practice despite the fact no deal has been reached to keep their QB in the fold.<\/p>\n<p>According to reports, the offer on the table for Fitzpatrick is 3-years, $24 million which includes $15 in guaranteed money. \u00a0Part of that guarantee includes $12 million in the first year, but from there it starts to come to light as to why Fitzpatrick remains at odds.<\/p>\n<p>According to ESPN&#8217;s Rich Cimini, Fitzpatrick&#8217;s compensation over the final two seasons <a href=\"http:\/\/espn.go.com\/nfl\/story\/_\/id\/15850245\/new-york-jets-wide-receivers-eric-decker-brandon-marshall-return-practice\" target=\"_blank\"><strong>drops to $6 million per season<\/strong><\/a>. \u00a0Fitzpatrick isn&#8217;t a dumb guy, having come from Harvard and he likely knows\u00a0how important his role is to keeping the Jets on the upward trajectory they finished on last season. \u00a0They have a good nucleus in place and bringing Fitzpatrick back once again makes them a dangerous team heading into 2016 that could surprise people.<\/p>\n<p>But that won&#8217;t happen unless they lock up Fitzpatrick, and give him credit for playing hardball. \u00a0Their current stance reportedly has the veteran frustrated, to the point they&#8217;re even <a href=\"http:\/\/www.cbssports.com\/nfl\/news\/jets-reportedly-fretting-ryan-fitzpatrick-will-take-less-money-elsewhere-out-of-spite\/\" target=\"_blank\"><strong>worried about him taking less money<\/strong> <\/a>out of spite. \u00a0The New York Post suggests <a href=\"http:\/\/nypost.com\/2016\/05\/31\/contract-shaving-compromise-that-jets-fitzpatrick-could-strike\/\" target=\"_blank\"><strong>making the deal a one-year contract<\/strong> <\/a>at $12 million and letting Fitzpatrick gamble and see if he can cash in during free agency in 2017.<\/p>\n<p>At 33-years old, he&#8217;s still got some good years left. \u00a0But at this point it&#8217;s been a contentious offseason and not having him around certainly isn&#8217;t helping their preparation. \u00a0That&#8217;s certainly fine for everyone following this story here in New England. \u00a0It&#8217;s always fun watching the Jet squirm, and it looks like this current mess is definitely far from
