Kraft case being heard this week.

This is still going on? That dump of a state loves to waste money.

Well, in all fairness, the hearing is scheduled for Friday but it'll be months before we get a ruling.
The hearing happened this morning numbnuts, I watched it. My $$ is on appellate judges siding with trial judges that tossed all the videos. Even the madames walk on this one.

So why does it take a multi-billionaire getting rounded up on the sting for the courts to recognize procedural legalities? It's all the justice and "law and order," that the courts represent, right?

This isn't another clear example of the very real priveleges only afforded to those with the means to pay for them?

I've seen belly-aching over the embarassment Kraft "endured" (as a direct result of decisions he willingly made, and circumstances he willing took illegal advantage of), yet no mention of all the other people rounded up with Kraft, who likely took whatever plea was offered.

The whole thing is a glaring example of the double standard financial means sets within courts. Sure, Bob obviously wasn't implicated in any human trafficing, but can he claim he had knowledge the woman pleasuring him ON TAPE, MORE THAN ONCE, was not a victim of human trafficing. After all, its certainly "more probable than not...". Meeting that standard with contrived "scientific reports" was enough for him to allow the best QB to play the game be tarnished over literally nothing.

Before you get to excited, remember Kraft is fighting to have it thrown out, like nothing ever happened, despite being literally being caught on camera with his pants down.

AB didn't even get a chance to face civil accusations. Tom Brady was villafied over nothing, and you feel the need to go to bat for the guy that threw both under bus?

He's a hypocrit, plain and simple. Do as I say, not as I do. You're far better than this PR. Jesus.

I have bigger issues with the police breaking laws to get this arrest than what Kraft did. The videos were gotten via a false search warrant. Secondly, I just don’t view paying for a handy as a big deal.

If Kraft wins, this isn't the sweeping victory against police overreach some seem to think it would be. Kraft's legal team isn't arguing the validity of the primary basis for the search warrant itself, but rather that the police did not do enough to minimize damage done to normal customers. In other words, they can put cameras in suspected houses of prostitution, you just can't record 24/7. You have to shut off if no crime seems to be occurring.

That said, you can't dismiss the potential for trafficing to be how the "servicing party," ended up in said position. Surely, someone as wholesome (think i just puked a bit) and publicity conscious as Kraft would understand this. Its not like Kraft left his wife literally on her deathbed to make sure the business didn't take a hit, nor immediately climb into bed with a woman younger than his kids once she passed.

Neither side of the kraft/police equation is in the right. Just because the cops didn't find evidence of human trafficing does not mean that Kraft shouldn't have at least pondered the very real possibility that he was leveraging a victim of such for "release." Not buying it? Then surely you can agree that said "pro" is an undoubted victim of financial circumstance.

And then Kraft buys his way out of being caught, literally on tape with his **** out? You don't see the problem there?

In the end, your strong defense of Krafts pure intentions is grossly misplaced.

Both the pigs and the rich dude can be wrong, it happens all the time, the courts just never admit it. Lack of accountability from people in power is the literal sole enabler of much of this country's issues.

If the case was garbage at a procedural level, it never should have been in court.

You are smart enough to know its rather likely the DA saw a "whale in a foot spa" and thought "this is my break!" The responsibility doesn't end with the police. A DA had to decide to bring charges. No disgust for that ****heel?

Just another example of how fundamentally broken this country is. When you have enough cash, you can just cut checks when silly frivolities like "laws" designed for the unwashed masses hampers your ability to squeeze revenue out of said filthy masses (filthy, but then theres those tricks that leave Bob cumming back for more, allegedly).

If it was me, my lawyer would beat it too the police were so corrupt. Again, no issues at all about paying for a handy. Which is just a misdemeanor anyway

What you’re not considering is the fact that if Kraft’s lawyers get this tossed based on police over stepping the law, all the other guys that got arrested get their charges dropped as well

So the rich guy’s efforts will help the guys that don’t have a lot of money. And let’s toss in the owner of the spa will have her charges dropped

I’m not sure if this reply was directed toward me or not Darryl. But if it was, my answer is that I’ve never paid anyone for sex. It’s not my bag.

But I don’t see how anything personal about another poster is relevant to this conversation. I also haven’t posted any venom or hate since I try not to attack a poster as part of my response. I try to stick to content

I suggest you re-read the thread and you’ll clearly see those that posted the anger & hatred. Seems like those posters have that classic “I hate rich old white guys” syndrome.

Personally, I try to view all humans through the same lense since no group is inherently better or worse than another

Assuming Kraft comes out on top, what are the states options to continue? Can they appeal to a higher court? Conversely for Kraft. Florida wins, can he appeal to the next highest court in the land?

Seems like that were talking about a case that could go all the way to the Supreme Court. Innocent (not Bob) patrons civil rights were clearly violated.

What does that mean they “have bigger fish to fry”? They got a warrant, the validity of the warrant is being tested in court, and they’re defending their own warrant. What are they supposed to do? Just let it go anytime a warrant gets challenged?

I believe the next round of appeals - should the loser choose to go that route - would be the Florida State Supreme Court. They’d probably take it on too.

And if Kraft loses, what does that make him? An innocent man being unfairly prosecuted by an eeeeeeeeeeeeevil government?

Any defendant could challenge what kraft challenged even with a public defender.

the reason people are talking about Kraft I’d because kraft is a public figure and you are reading a message board about the team he owns. I’m sure the other defendants are being talked about by people who know them.
 
I'm going to go out on a limb here and say I'm pretty sure I'm the only one here who has ever monitored a wire tap........

What the police did wrong here was not their warrant or the probably cause to get the warrant, it is the fact that they did not "minimize" their intrusion into the private conversations of innocent people.

Before you can even enter the room where the records are being made, you have to be "minimized" by a DA. The DA will read you a specific sets of instructions on when you can and can not record (for instance, if the target is on the phone with his wife, lawyer, doctor, etc.) you have to hang up, not listen and not record. The Police in this case did none of this! They didn't minimize at all! They just pressed "record" and didn't even attempt to minimize. So their is no way this case holds. It is going to get tossed.

Its the "fruit from the poisonous tree" doctrine. The Cops should have known better and they are going to lose because they failed to follow basic universal proceedures.

So that is the legal case, and it is not some bit of legal trickery open only to the rich, I would dare to say a kid right out of law school would have gotten this tossed too.
