If they were in settlement talks that long, there is absolutely no way Rosenhaus did not know. So either he informed the Pats or he didn’t. If he did not, he has severely trashed his credibility. If he did, the Pats are lying now.

Confidentiality agreement

Why would he inform them?

According to ESPN's Jeff Darlington, Antonio Brown began settlement talks with Britney Taylor in April including mediation in May, but ultimately chose not to sign an agreement that would have paid his accuser over $2 million.
The deadline for a settlement was last Sunday at 10 PM. When Brown declined the terms, Taylor filed a civil suit in Florida, seeking damages for three incidents of alleged sexual assault. The lawsuit was filed Tuesday, a day after Brown's Patriots contact became official. NFL Network's Ian Rapoport previously reported that New England was unaware of any settlement talks between Brown and his accuser while adding that owner Robert Kraft wouldn't have signed off on his deal had he known AB was facing such allegations.

No, he hasn’t.
If Brown was negotiating confidentially Rosenhaus (a) may well have been a party to the NDA, and (b) even if he wasn’t he would have destroyed his reputation with players in all sports if he said anything to NE, which is something BB and NE would absolutely understand.

Refused to agree to pay $2mil? Huge mistake. Even if he didn’t do it, this becoming public is gonna cost him way way more than $2mil.

I'm not entirely sure just how high his credibility stood prior to this. That said, he probably has a confidentiality agreement that prohibited him from disclosing any of it. If so he no doubt made the fact his hands were tied known after the suit was filed. It's hard to believe that would be held against him professionally.

Edit: it appears QM posted a similar thought while I was typing this post

I wonder if Kraft would have signed off on someone facing accusations of human sex trafficking.

Why should he? I’m sure he wanted this woman off his back but now she’s going for more. Again he must feel confident he can win in court. 2 million is probably chump change for AB.

I don’t understand how Brown’s attorneys didn’t have the paperwork to file a counter suit within 24 hours, if they’ve been discussing this for months and knew about the deadline.

Nope. Federal circuit court decisions are horizontally binding as well as vertically binding.

CA2 panels as well as all the district courts in the Second Circuit are bound by Brady unless and until there is an en banc CA2 decision overturning it (or SCOTUS overturning it, of course).

You don’t get it. Cases can be distinguished because the facts are different. Different panels with different judges can yield different results. This happens all the time.

They did counter file for civil extortion almost immediately, didn’t they?

If he is vindicated I am not so sure of that. In fact if she is thoroughly exposed as a fraud, which is looking possible ATM, he may actually profit off the backlash. Before anyone discounts that I'd invite them to consider there's a lot of anger out there to be exploited for gain. Look no further than Kaepernick reaping more off being a professional martyr than he would have ever made carrying a clipboard. Having seen/heard his net worth estimated between $32M- $38M why would he cough up 5% of it if there's nothing of substance there?

.

I believe they said they “will be” filing in a statement.

Not quite, his attorney almost immediately said they plan to which is hardy the same thing as actually filing it. That could just be a tactic or it could mean they wanted to see her hand before going all in against it and their countersuit is forthcoming.

Why pay 2 mil for a crime you didnt commit?

Kobe Bryant won an oscar at an academy awards where everyone was wearing black ribbons for me too victims.

If brown didnt do it, it all blows over eventually. And even if he did like alot of people think kobe did, it blows over.

You missed my point. Even if he easily wins in court and pays nothing, it’s gonna cost him way more than $2mil in lost endorsements, etc. Would have been better to pay her the $2mil with a “if you tell anyone you have to pay back the $2mil” rider, no matter how galling it would have been to pay if he didn’t do anything.

Seems a bit contradictory to say 'why should he' and then call $2M 'chump change for AB.'
It may be hard to visualize but $2M is 5% of AB's publicly estimated net worth, hardly chump change.

I take it as good news he didn’t pay because it appears he feels he’s innocent and she’ll lose. Why should you pay someone $2M if you feel you didn’t do anything? It may not be a lot to him, but it’s the principle - nobody wants to dish out money to people looking for handouts.

In addition, countersuing her could make her force her hand as I’m sure she can’t afford all these lawyer fees.

I believe he has made over 70 million dollars in his career. We shall see what happens.
