Actually, now that I think about it, your proposal makes even less sense. You are basically saying that the prosecution can ask "Did you do the crime?" and the defendant is required to say "yes" if they did it. In other words, you are fine with compelling people to confess. Don't know how you can support that and somehow claim to be a libertarian!

Huh? The courts already compel all other witnesses to testify and tell the truth by taking an oath. So what exactly is the outrage for here? That someone is...gulp...forced to take the stand in a trial? The defendant will almost always say no, acknowledged. It's about whether or not the jury believes the person, and it isn't just about the "did you do it?" It's about accounting for alibies, contradictions, statements, etc.

Your libertarian line is truly one of the most non-sequiturs I've read on this board.
 
The 5th amendment protects the innocent, not just the guilty. Imagine you are innocent of a crime, but circumstances paint a picture that doesn't look good for you. This is why defense attorneys routinely decide not to have their clients testify. Now imagine being compelled to testify and getting convicted of a crime you didn't commit due to the circumstantial evidence you provided.

If it means providing factual evidence to be interpreted incorrectly, leading to the imprisonment of an innocent person, I'm fine with the accused being exempt from providing such info. The framers were also fine with it. The country as a whole is apparently also fine with it considering we have a mechanism to change the constitution yet the 5th ammendment remains intact after almost 250 years.

Ignoring the potential abuses already outlined, keep in mind all other witnesses that take the stand also have the right not to answer a question that might incriminate them. At this point it honestly no longer seems you are seeking to clarify the value of the 5th Amendment but somehow craft an argument to both fit your desire and defeat any reasonable counterpoints that have been made. We are talking about one of the most fundamental rights of a free society, protection from coercion, manipulation and the potential willful misinterpretation of testimony in a court being used to deprive someone of their freedom or potentially their life. As a professed "Libertarian" how do you square the core value of individual liberty with the idea of forced testimony? Why isn't Ben Franklin's axiom "That it is better 100 guilty Persons should escape than that one innocent Person should suffer, is a Maxim that has been long and generally approved" more aligned with your political philosophy?

Not saying this in a confrontational way but you seem to be channeling some type of inner Andy on this one. You are so determined to carry your point that you're actually arguing for the elimination of one of the most fundamental guarantees of personal liberty.
