Marriage is a factor. Wills are a factor. Family and next of kin are factors. But being a girlfriend is not a factor.We have no idea if Kraft wants to marry this girl.
With that said when it comes to estate, trusts and entitlements, marriage is a factor but not the determining one.
There would be no need to have it amended if all they wanted to do was keep her out. She is not his wife (common law or otherwise) and, according to Mr. Kraft's official statement, the child is not his. She has no legal bearing whatsoever to, as you put it, "pull an Anna Nicole Smith."Its all based on what is in the will and in the trust which is why the sons had it amended.
Being a girlfriend gives no legal rights whatsoever to claim someone's inheritance, nor would it afford "next of kin" status if there was no will. The only reason to amend the trust is if they want to put her in it. There is no reason to amend it to keep her out since she already has no legal standing at all.
