And if it does go to new arbitrator, the Wells/Pash Report has just been toasted, no? What "evidence" even remains viable?
I think it is incomprehensible that a fair arbitrator could possibly find the evidence sufficient.
 
Yeah, me too. this is getting really juicy. Berman is ripping nash, wells, and goody a new one. Nash throws Goody under the bus. This is great to read after months of it being one sided in favor or the nfl.

The Nfl may seem mighty, own tv and radio, especially Bspn. But in the court room you see how weak and fragile they really are.
 
Are you unaware that innocent parties have settled in court on a number of occasions?
He doesn't understand it would not be an admission of guilt regarding deflation of footballs. It would only be an admission in his own eyes. There is a big difference there. People on this board don't seem to understand the difference (which is huge).

Unbelievable that NFL compared deflategate to performance enhancing drugs.
To me that was an unforced error given the PA's notice argument. There are specific penalties defined in the CBA for PED's and the PA's been arguing that Brady did not receive sufficient notice of potential penalties for ball tampering or non-cooperation.

Sounds like Jared is getting his just desserts. Pictures of a six year-old? That six year-old is the one who had a bad day (or days) at some point. WTF is wrong with people?
 
Kessler conceeded the non-cooperation (phone) issue and stated that it could have been handled better.

That's fine. But his statement that both parties' arguments are basically equal is stunning. I know he's driving towards a settlement but it's disingenuous to say the pros and cons are equal. That's just not true. Legalese be dammed. I'm just tired of the BS.
 
Did Judge Berman really use the term "grounds to vacate?" I'd like to hear from a litigator, but that sounds like a threat to me. Not that he is going to vacate because Pash is a no show but that that he's seriously considering vacating.

It sounds like judge speak for "settle or you're going to lose." I actually hope the NFL continues to be tone deaf if that's the case.
 
I really don't see a settlement. I think the league has accepted losing this round and is probably turning their attention to the appeal.

I would imagine Brady is fine with that. Someone here mentioned Judges, next to being lied to, hate losing to appeal almost as much. So I'm sure Berman crafts his ruling around those possible pitfalls. 2yrs, who even cares then?
 
Roger Goodell didn't believe Brady, so is Rog prepared to just come out and say Brady is a perjurer then?

That's the crux of the matter - the NFL are so into getting Brady/the Pats they're now accusing him of perjury.
 
I don't know if anyone posted this, but this is hilarious:

"What's the problem having [Pash] testify?" asked Berman. "He edited the Wells Report. Nobody else edited the Wells Report. He was the co-lead on the investigation with Mr. Wells."

Nash responded that Goodell felt Pash "was not a relevant witness," which is why Pash was not questioned during Brady's June 26 appeal.

According to Nash, Goodell did allow the NFLPA to question Wells as to Pash's importance. Berman appeared to waggle his head upon hearing that explanation.

Nash also blamed a press release announcing Wells and Pash as co- investigators as having fermented unnecessary interest in Pash's role, to which Berman said, "Well, you all wrote [the press release]."

@jeffphowe Given that the NFL got a legal colonoscopy without anesthesia in court today, that probably would be accurate.

Makes sense after we hear what went on today. Berman laid the smack down on the NFL.
 
unsurprisingly, a lot of peeps here are disappointed at the thought of brady settling. i want the whole thing wiped out as much as any other pats fan. however letting the judge make a ruling, as opposed to settling, could have negative outcomes even if the judge rules in our favor.

a settlement means its over. a ruling leaves open the potential for more court cases and more media BS.

i dont want brady to accept a game as reports are suggesting (sounds like a last ditch leak by the nfl anyway). but i can understand why he might opt for a settlement. no pats fan, player, or coach wants this to carry on later in the season and/or the playoffs. so i can understand the logic of accepting a BS fine and then cleaning up the rest of the mess by kicking ass on the field. **** You NFL Tour 2015!
