    First they give us Mark Sanford's new definition of hiking the Appalachian trail as well as a gubernatorial candidate who had two people come forward and claim to have affairs with her. (Memo to Juan Williams of FoxNews- she is not the first "native American" Republican candidate- she's Indian-American as in Sikh heritage, not native American). Yes they were both Republican but not to be outdone, the Democrats come forward with one of their own.
    Alvin Greene, an unemployed army veteran who shocked the Democratic establishment with an upset victory in the Senate primary is facing a felony obscenity charge

    As long as we're bashing South Carolina a bit, here's an anecdote for you.

    While working on a major commercial real estate deal in the Charleston market, we were teamed with a senior broker from a local family brokerage. They were part of a major family down there and part of the Charleston establishment, including membership in some very exclusive club down there (for high-rolling good ol boys from old families).

    In any case, the day on which due diligence is ending, we are trying to reach them. No luck. We have our assistant try to track them down, calling their assistants, and finally getting in touch with their retired father. He says they went out fishing (on a day like this?!). He gives us the number to the senior broker's satellite phone, and we finally get him. We're on speakerphone, with our senior broker talking to their senior broker:

    "Hey John, this is Robert up in Virginia, where are you guys?!"

    "Hey Bob! We're about six miles off the coast, barracuda fishing! Loving it!"

    "You know, John, that due diligence is ending today, right?"

    "Uh...yeah."

    "Well, I need to discuss a couple of-"

    From John's phone: BOOM! *cheers*

    "What the hell was that, John?!"

    "Well, Bob, we're catching barracuda and then shooting them with shotguns!"

    And there you have the upper crust of Charleston, South Carolina.

    I just want to learn more about what constitutes a felony "obscenity" charge...

    Without getting too legally here, the Miller Test (Miller v Cal. 1973) establishes three prong test which all prongs must be fulfilled to be considered obscene.
    1)Whether using community standards, it appeals to the prurient interest of the person.
    2) Is it patently offensive by showing sexual conduct, contact or function.
    3) Does it have any literary or scientific value?

    Obviously the community standards in South Carolina are going to differ from Boston or San Francisco or the Northeast.
    Something that might be labeled NSFW here might be considered felony obscenity down there so who knows what it was that got him in trouble.

    To be fair, there are some Darwin Award candidates up north as well. I was on a plane heading into the Gulf coast after Katrina with exclusively rescue and recovery workers, 10 days after the storm hit when the airport was first re-opened. The pilot flew low over the coast so we could get a bird's eye view of the devastation. It looked like I imaged European cities were after World War 2. Every home that hadn't been leveled had the blue tarp covering a damaged roof.
    The plane was completely quiet when a voice from the back piped up, " is it a cultural thing to have a blue roof down here?"
    They breed and they live among us....

    yeah, but what struck me was the felony part of it

    (heh, it may have had something to do with a different sort of 3-prong test...)

    Oh, very true. I suppose what made this different was that these guys are the upper crust of the Charleston business and social establishment. The Kennedy-lites of Charleston, if you will.
