He could turn out to be a very important person in the case against Sonia Sotomayor. She's pretty much a slam dunk, though her vapid response to the affirmative action challenge doesn't pass the smell test.

The mediocre beetch thought she could sweep it under the rug. Sorry, Sonia, now you'll never be able to live it down.

He could also jeopardize his appeals... otoh she did what she did in the context of the law and in conjunction with two other lawyers .. she did not act alone, it is not as though she met him in the hall and said "gonna get you white boy"....

Seems as though people are grabbing on to false hope by believing that Ricci can make a difference, pretty confident that she will be questioned on the merits of the case not the personalities of the people involved ... Justice is supposed to be blind.. or so they say.

Not quite sure why polls are taken about this stuff, as Justice is supposed to be blind.. but it is what it is.

Democratic majority, union fight, their biggest support group...gee hard to see why it might be an issue with many people

That and the other overturned cases have merit...especially when one of the most important cases that can and will affect civil service testing across the country.

But why let a major overturned case like that get in the way all the "personal qualifications" that surround her

Why hold her accountable for how she voted and what she said on the bench when it will affect the country for the better or worse for the next 25-30 years?

Trotting out the justice is supposed to be blind line?

Save us the whining, you are mad that people found something that will affect them directly that she is linked to and that she is the face of.

Heaven forbid they grill her anywhere near half as hard as the last three nominees were grilled...

There is no whine, the reality is that Roberts got the soft touch approach.. Specter treated him with kid gloves.. not sure you watched the hearings, but it was slow curve after slow curve...

Sonia is a affirmative action balabusta. The country's smartest man, Dr. Thomas Sowell, says the same thing without the Yiddish:
    Equality...or pay-back?

If Dr. Sowell says so, must be correct, nice to see you anointed him with this position as Country's Smartest Man.. he is just another right winger .. one nice thing about all of his right wing views is that he does endorse the decriminalization of pot...

It's whining. It's whining of the worst kind- whining that they are actually doing what they are supposed to do.

I watched the damn hearings, did you?

Spector asked a major question that once answered "correctly" by Roberts they couldn't hold against him, that of his religeous views and their affect on his decisions. Sure sounded like kid gloves to hand him a loaded question that could have blown up the process

Sounded very softball .. they did not rake him across the coals.. the outcome seemed to be predetermined as they often are in these proceedings.. and will probably be the same for Sotamayer..

    Yea I watched the hearings..

What it sounds like is that there is an attempt to tie this whole thing to Frank Ricci, and that case has not yet been decided by the Supreme Court.. even though many of you think she and the triumvirate erred.. you never really know until the decision was made.

I am. I am also aware of the OUTCOME of it and its affect NATIONWIDE

ALL OF THEM. An overturned case is a black eye to justices and a huge hurdle that they have to answer for especially ones that were argued in front of her colleagues

BS, you understand it. It's the positive attributes the President was touting about her when she was first nominated

Yet the left is doing the most whining...

One final question and will let this go, as it is descending into idiocy.. Do you think if Sontamayer is confirmed it will be the end of the Republican Party as Herr Rush has predicted???

You need to go back to civics class: once they make their decision and either it is overturned or it is not it affects EVERYONE not just New Haven nor the 2nd district- EVERYONE.

It's binding across the country. Any case similar will be held to their decision regardless of the justices in that district's personal beliefs or impending decision as the higher ruling wins out

Every union will be paying attention, every civil service test will have to conform to their decision.

Actually, that's pretty bad according to numerous sources...and it could be even worse than that number

    Idiocy?

You get called a boob and whine about personal attacks and go right on and say that...really living in your own world Darrly

Not biting your bait, you are trying to make a tangent to dig yourself out of your hole.

If you prefer the intelligent, informed method here are somethings they may talk about.. unless you are just another hysterical right winger who hangs his hat on half assed blogs and the famous straw man...

If you study and read about this decision devoid of hysteria at first glance it does not make sense or is arbitrary.. but if you read it and some of the other issues associated with it, all it does is say that there was no error as the Civil Service Board had to follow the law as defined by Title VII...

    http://www.rbs0.com/ricci.pdf

The case hinges on Title VII which is part of the Civil Rights Law.. if you want about the arguments before the supreme court and those who filed amicus briefs this gives a pretty good rundown.. and a good oral argument recap..

Nope. They tried. This is before the health troubles of Teddy Kennedy. But John Roberts is too freakin' stellar.

It's called not being able to land a punch on the target, who is too fast, skilled, and powerful.

The man was so overwhelmingly competent, reaching Platonic levels of jurisprudent excellence, that the bright light made the Democrats close their eyes.

Plus, Specter was then a Republican...at least nominally. So why would you think he would go after him?

Soto-keeptheaffirmativeactioncoming-meyer was part of a three-member panel that gave the Ricci case a one-paragraph summary not even invoking the law. This suggests that the merits of the case were so unworthy as not to warrant a detailed explanation.

Yet that very same case is was heard by the Supreme Court.

Hmmm. That suggests she was wrong, doncha think? This is not me, this is the New York Times, see link below.
