    Ted Olsen, Bush's former solicitor general (and a conservative from the Reagan area) is one of the two key lawyers in the gay marriage issue that's headed to the Supreme Court. In this interview with Fox News' Chris Wallace, Olsen convincingly explains the Constitutional argument for gay marriage.

    I think he pretty much shows that the Supreme Court will have to be activist in order to rule against gay marriage.

    The case is very strong, indeed, just as Justice Scalia noted in his tremendous dissent in the spectacularly awful decision Lawrence V. Texas in 2003.

    Just a few years before my birth all fifty states had laws against sodomy. There was a 1986 SCOTUS case that prohibited treating homosexual sex as a protected category in Bowers V. Hardwick, which Lawrence patently ignored.

    So the Black Robbed Tyrants are on your side, Patters. They've got your back covered.

    Even without being a legal person ... I have said for a long time that to be a free nation we must have the same laws for all people. We don't need to worry about procreation ... we certainly don't need marriage for people to make babies.

    I think it horrifying that we continue to openly be racist vs gays in our own laws. We discuss black vs white racism all the time, but blacks have all the same freedoms as whites - gays do not and that is a sad statement for a supposedly free country.

    We have laws that discriminate. Incest, polygamy, bestiality, etc.

    Until about 18 years ago there was largely a consensus that sodomy between men fit into the above-mentioned category.

    Now you'll have to explain to me why I can't marry two women at the same time. By your rights talk--without any reference to culture, custom, religion, or morality--you can't. For the two or three people here who remember Geo. Washington's "Farewell Address," the "twin props" of republican governance are "religion and morality." Look it up.

    Furthermore, the argument against humans "marrying" animals is now tottering, like that woman in Conn. whose ape "husband" tore off her friend's face.

    One has to wonder just where your mind lives, State, since this is the first time I've ever heard anyone refer to the chimp as his owner's "ape husband."

    To the contrary, every article written about them which remarked on their unique "relationship" made mention of the fact that she regarded him as her "child."

    Not "husband," not "sexual partner," not "boyfriend," not "lover," but CHILD.

    Which a lot of pet owners regard their pets as - children.

    And so on and so forth, ad-infinitum. I defy you to find an article which states she (or anyone else) regarded the ape as her "husband."

    While you're at it, maybe you could explain to us how and why you, personally, made that leap.

    They also had laws against interracial marriage, as well.

    Should those be brought back, re-examined, and put back into place?

    You neglect in your frantic google searchings that she also had champagne with her ape, had him comb her hair, and even took baths with him.

    I think this behavior is more indicative of a spouse than a child. Though I'm sure she did engage in mothering, too.

    The laws against interracial marriage were not stricken down by The Supreme Court until 1967.

    That would be "late 60s," I believe.

    The women and the Chimp, she claims it was her son but who knows what went on after the lights went out?

    From your story it sounds as though that poor women belonged in a Mental Institution, I really hope that her story would serve as a lesson to other disturbed people out there.

    Maybe we need some laws regarding "Chimps" (not to be confused with Bush)

    Washington also spoke repeatedly of liberty and freedom, the importance of the constitution and the federal govt and the danger of parties.

    He was also a slaveowner.

    In other words, any time you rely on the words of somebody more than 2 centuries ago, even a founding father, you're probablygoing to find yourself cherry-picking.

    I think every group has the right to make it's case. It seems to me that those least likely to succeed are those who want to marry children or animals -- because there are obvious cognitive disparities involved. Now that interracial , interfaith , interclass , and in some cases gay couples can marry, you're right that other groups may begin to educate us. I am not completely close-minded to the idea of polygamous marriages, though I do have major concerns. As far as animal-human marriages, I think I'm fairly representative of the liberal wing of American politics, and I think there's if anything less support for that kind of marriage on the left than there is on the right.
