Raiders sent the 5 day letter to Seymour

    Update on the Richard Seymour situation at 3:35pm

    CSNbayarea.com spoke moments ago to Chronicle Live Host and voice of the Oakland Raiders, Greg Papa, to get the latest news on Seymour's status.

    Papa said the Raiders' position, simply put is: they want the player.

    Papa also said the Raiders have sent a letter to Seymour saying he had five days upon receipt to report to the Raiders and take a physical.

    Failure to do so could result in Seymour being placed on the Raiders' roster/suspended. This would mean the Raiders could keep him on the roster/suspended for this season and then retain his rights in 2010 for his 2009 salary.

    When the Raiders sent the letter is not precisely known, however

    This eliminates the speculation that not reporting for the physical can be construed as failing it. The Raiders have gone on record that he is their property and if he doesnt show in 5 days they deactivate him.

    Common sense would indicate that if they sent the letter they own the player.

    You cannot send a letter that will suspend the player for the season and
    then expect to void the trade.

    Seymour would not be able to return & play for the Patriots in 2009.
    The Patriots will not be able play or trade Seymour in 2009.

    The machinations of the CBA, its parties, the impact on the future, and the decisions to be made if he doesn't show up is a much more interesting 'watch' to me than Richard Seymour playing D-line in Oakland.

    Seymour would be CRAZY not to play. If he doesn't think Al Davis will put the screws to him, he should talk to Marcus Allen.

    I HIGHLY doubt that the league wouldn't look into that and impose penalties on Seymour/ the Raiders. He's played this preseason and clearly he's fine. This isn't some player signing in April that is coming off knee surgery.

    I dont believe Al Davis can feed himself at this point, much less put the screws to anyone.
    But I do agree that Seymour gains nothing by not playing and the Raiders are the wrong kind of enemy to have, mostly because they will spend money to ruin you even if it they cant gain anything themselves.
    If you don't like Richard Seymour you couldnt have wished for a better development that this trade.

    My understanding is that if he fails the Raiders' physical, the Patriots can administer one with a doctor of their choice. If those 2 conflict, the league appoints a doctor to examine him and make a final determination regarding his condition.

    Good find on the Suggs situation.

    However, the league would be dumb at this point, with everything else that's happened and Seymour's own voiced displeasure, to fall for this one. Meanwhile, the Raiders have cut three players to make room for Seymour on the roster, and the Patriots have already replaced him. If he were to "flunk" the physical I doubt that would be the last of it.

    Was referenced in another thread. I agree it's unlikely this deal falls through but my Dad taught me that it's just a rumour until it's in your pocket.

    I wonder if this is why Belichick opted for the 2011 pick. If it's a 2010 it's a bit of a distraction but by 2011 this situation resolves itself even if it means the Raiders send him somewhere for a #1 pick in 2010 or 2011.

    That would be funny ... if we end up picking before them in 2011 with their own pick.

    I've thought this over and could see a scenario where that could be possible, but unlikely.
    If Seymour reports to take the phyiscal and tells the Raiders he won't play for them, then the Raiders would have an incentive to be overly strict in the physical.
    There are numerous problems with this theory though.
    1) It assumes the Raiders have been convinced by the media that they made a bad trade
    2) Why would Seymour take the physical if he doesnt want to play for the Raiduhs?
    3) The Raiduhs would expose themselves to a boatload of problems for failing Seymour with an injury that is less severe than they have allowed players to play with. Think of it. Seymour failed his physical because of his knees. Raiduh X has knee issues, then sustains an even more serious knee injury. Lawyer X subpoenas the Seymour file and sue's the Raiduhs for negligence because they let the player play with a more severe injury than Seymour had when they said Seymour was too injured to play. Big can of worms to open.

    In the end the only way for a phony fail on the physical is if Seymour reports to take it and then the Raiduhs decide they dont want him. They would only not want him if he was going to hold out, and if he was going to hold out he wouldn't show up for the physical.

    Am I missing an angle?

    Nah, we'd be OK with Biden because instead of putting in the current codes he'd copy the ones a previous administration wrote down.
