This whole situation might have been somewhat different if Goodell appointed a neutral arbitrator, however either because of owner pressure or his own ego he decided that was his role and he was not going to relinquish..

Not sure if a bargaining agreement can be case aside in light of other legal factors.. have felt from the onset that Goodell impeded Brady's due process rights..
 
Still a bit surprising, but this guy's a power hungry S.O.B.
This has nothing to do with what the Commissioner wants and everything to do with what the "Full 32" want. As it stands, the NFL is the only major sports league that doesn't have fully guaranteed contracts and it is the owners' singular goal to preserve the status quo. This Brady "skirmish" backed by the NFLPA is just another turf battle designed to move the goal posts closer to the ultimate goal of fully guaranteed contracts. The greatest fear for NFL owners is for the NFLPA to acquire the kind of power the MLBPA has achieved. The NFL is all about leverage and creating high value chips for when the next collective bargaining negotiations occur. In this case, the Commissioners power to discipline is an expensive chip that the NFLPA does not want to bargain for again. Why relinquish currency if courts can do the job for you?
Think of any major social change that has occurred in this country and history will show you decades of minor skirmishes designed to move the goalposts. Chipping away....chipping away. In labor/management struggles.....battles are forever being waged. Business is a blood sport.

I think there might be a chance that the owners make this happen at their meeting next week. Even the ones who support the penalty know this is just absurd at this point. I just don't know if they'd be willing to take away Goodell's absolute power now as opposed to saving it to use as a chip in future collective bargaining.
 
I keep laughing at the arbit part. How can you take away a power he never had? Again, if the commissioner is the only one that had the power to render punishment, how in any case could be an arbitrator? The whole Vincent thing stinks and plays a great part in Brady's favor.

"Never make misrepresentations, dishonest statements, or statements that may mislead or misinform. If it appears that anything you have said or written has been misunderstood, correct it promptly"

Clearly the NFL Offices are in violation of that policy and more - more so the NFL policy states that there is an OBLIGATION to report violations to "protect the shield" and "uphold the integrity of the game

Furthermore the NFL Offices are also in violation of the "Bad Faith" clause as noted on the main page

"However, if a report is made in "bad faith," for instance, if a false or misleading report is made in a deliberate effort to get someone in trouble (as opposed to an honest mistake), the person making the report may be subject to disciplinary action."
SO - the question becomes, what fines will Goodell/Kensil et al incur for making misleading and "bad faith" reports... and it also begs the question whether anyone in Goodell's office - or any of the other owners acted in bad faith either making false reports or allowing misinformation to continue for so long

I think you have the right idea but wrong details.

There is no doubt that every action by the owners is to keep down the players. The owners truly have just one enemy, the NFLPA and its members.
Having a strong commissioner with excessive power helps that, given that they want the commissioner to be able to mediate between the owners, who he is employed by and the players, who is charged with keeping down.

The detail though isn't fully guaranteed contracts, its the salary structure and cap.
Owners really do not care (financially) if contracts are fully guaranteed as long as they are in the cap.
Paying a guy who is sitting home 10 mill means paying 10 mill less to someone else.
Of course, it would be a competitive issue, but the owners aren't truly concerned about that, as long as the game stays popular.

So, do we report Kensil for antitrust activity, confidentiality & misappropriation, conflict of interest, offensive or inappropriate language, violation of policy or finally...violence or threat?
 
LOL, you think if we all fill one out it might get a mention or just ruin some secretaries day?

If we all coordinate up and send the same report on the same people (you can file against 3 people in one report and add in any senior management you think may have known) then it's worth a shot.
