Re: OT: Bears Charge 49ers with Tampering

It is actually worse. Tampering charges are just much harder to prove. That is why the Branch thing went nowhere. But in this case, the 49ers admit to talking to Drew Rosenhaus about a new contract for Briggs. So instead of the team that was being tampered with trying to prove contact between the violator and agent, now the violator has to prove that they had permission to speak with the agent. I think the 49ers have a very good chance of getting punished for this.

Yes but in the drive by media, there wont be days and hrs talking about it, it just will be mentioned for 1 day and move on.. We wont be left alone till the Pats are not a franchise anymore..

Re: OT: Bears Charge 49ers with Tampering

Yeah, tampering is far, far worse than videotaping signals. As we saw with both the Deion Branch and Lawyer Milloy thing first hand, tampering can make it impossible for a team to keep one of their star players.

The Bears may have lost any chance they had to resign Briggs because of that tampering. The 49ers could have offered Briggs such a huge deal that the Bears had absolutely no shot to retain Briggs eventhough they have exclusive negotiating rights to him until next Friday.

Re: OT: Bears Charge 49ers with Tampering

If Goodell takes away a significant draft pick like a second or third rounder, it won't go away that easily especially with the 49ers already missing a first rounder. It will be a topic of conversation leading up to the draft. It can't go away that easy then.

The Niners do have the Colts first round pick.

But I don't think they will take that pick, IMO they may take the first rounder for next year. But that is just my own speculation.

Re: OT: Bears Charge 49ers with Tampering

    This from the article....
"The 49ers’ counter is that they talked to the Bears first about a possible deal, then contacted Rosenhaus and the NFL Management Council about signing Briggs to a new contract."
Seems like they felt they had permission. I mean who makes a trade without talking to the player to see if they are interested in signing a long term deal? I doubt they get punished for this.

Re: OT: Bears Charge 49ers with Tampering

Consideirng that Briggs is going to be a Free Agent, the 49ers and Bears can't make a trade involving Briggs.

    So, your point is moot.

The fact is that the Bears were probably still in negotiations with Briggs when the 49ers came and asked them how things were going with attempts to re-sign Briggs. The Bears probably said "Not Good" so the 49ers felt they could go talk to Briggs since the Bears weren't going to be in a position to re-sign him.

Re: OT: Bears Charge 49ers with Tampering

And what you described is a clear case of tampering. So exactly how is my point moot? You are guessing that the 49ers cheated by tampering. The only time you can talk to a player under contract is with permission from the team. There is no "Not Good" exemption to the rule.

If the 49ers talked to Rosenhaus any time before February 29, 2008 about Briggs without expressed consent from the Bears that they are allowed to talk to Briggs and his agent, they tampered which is cheating. Plain and simple with no shades of grey.

P.S. The Bears are alleged this happened prior to the trade deadline in 2007.
