Obviously the federal court system can work. And yes it can send a message to France and Stockholm but somehow I don't think the Taliban or Al Quida are that impressed. I have a question, when is it appropriate to use the Military, FBI or the CIA for interrogations and prosecutions, ever? What would you say if giving the wrong guy the right to remain silent allows another 9-11 type attack? What if a terrorist’s parent can't convince a protected enemy of the state to start talking again? These aren't just talking points here are they? Aren't these legitimate questions? There has to be some defining point when some of these guys just don't fall under the same protections of the common criminal.

Not sure anyone can answer your question.. but the reality is that the military court system for terrorists has been problematic, have to have some confidence in how the civilian system has worked and its results.. even the bomber on the Detroit Xmas event is talking..

This is a pretty good history of how difficult and unweildy this system really is.. if we get good results in civilian courts, why consider an alternative..

This is a federal offense tried in a federal court.. not a state court, jurisdiction issues.
