    I'm not sure if this is actually "new" but it has a few details.

    Basically it sets the dates (July) and notices that BB was Deposed. It still doesn't say the effect on the Cap should the decision be favorable and when and collections and so forth.

    Use that money and give it to Abraham...immediately. Maybe that's why he's holding out? Doubt it but maybe.

    We really do need more big bodies inside for Vince insurance, and Abraham doesn't give that. But he is talent on the edge, and you can never have enough of that.

    I'd love to see us take a look at Seymour. I know it's not going to happen but I'd love to see him back.

    I am pretty sure it was discussed before and if the Pats win, they get the money on next year's cap, not this year's.

    If the Pats win the hearing how is that handled on Fanene's taxes? ;)

    FWIW, Underhill had some additional comments that were not in the above article:


    Another source says “the Patriots aren’t going to like what comes out” during the Fanene hearings. Said it will expose some things.


    When asked to expand, Underhill said that he was "not allowed to tell" and that he "was asked not to say anything more. It kills me."

    Again, take it for what it's worth. It's either a source leading him on that he will never again trust, or perhaps somebody that actually does have some inside information; time will tell.

    That doesn't make me feel too hot hearing that.

    Lord help us all if there are some kind of accusations about the way they dispense painkillers, or that they aren't following league protocol etc. It'd be even worse if Belichick himself ended up looking bad somehow.

    One thing that stands out is that it would be kind of strange that the NEP would even consider trying to recoup this money if they already knew ahead of time that something shady may come to light. That's the one thing I can't seem to understand when trying to assess this.

    Then again, the way this team handles controversy and PR issues (or lack of PR) leads me to believe that anything is possible.

    My fear is that the PFT and ESPN reporters will be waiting outside the courtroom for 10 days ahead of time, waiting to pounce on any/all bad info that may come out regarding Bill Belichick...or otherwise. I don't like it.

    There was a "tell all" book about the NFL a few years back that had the Saints playing injury games with players. Forcing them to play so they could cut them without IR. The Patriots weren't talked about much in the book except how nice Brady and all the OL were to one prospect who never quite panned out in the league.

    What are the cap implications of this development? There was $2.5 million at stake as mentioned by the OP. If that comes back to the cap, the Pats could make a move or two and still keep enough on hand for mid season emergency pickups.

    At the moment, nothing. Essentially the Patriots filed suit, and the NFLPA filed a countersuit. The countersuit was dropped. But that doesn't mean Fanene is guilty in the Patriots suit. We still have to wait for a decision on that case.

    We already have plenty of cap money to make a "move or two". Even allowing $3.5M for in-season pickups, we have about $4M a year to use if we wish. Arguably, this would be enough for almost anyone that we might trade for. There are no free agents that would command near this amount of cap room.

    There are no salary cap implications with this news.

    If the Patriots had won, they would have gained extra cap space.

    By not winning the case everything stays the same.

    At this point, it sounds like the ruling hasn't been made. This happens a lot of times in arbitration cases. It could be another month or two before a ruling is made since there is no hurry to make a decision since if the Pats win, they would not get cap relief until next year.

    My bad, I mis-read the 'new news' part above.

    However, my understanding is that if the Patriots should lose their case, they don't lose any cap space.

    They gain cap relief if they win; don't lose any cap space if they lose.

    1a. The Patriots and defensive lineman Jonathan Fanene (represented by the NFL Players Association) settled their grievance within the past week, according to sources, and part of the settlement is that the Patriots won’t have to pay Fanene the final $1.35 million of his $3.85 million signing bonus. When the Patriots had signed Fanene in March of 2012, the contract called for the $3.85 million signing bonus to be paid in multiple installments, with the final $1.35 million on March 31, 2013. We all know what happened -- Fanene never played for the Patriots and the team released him five months after signing him with the new “failure to disclose physical condition” designation. A grievance followed. We can now officially close the book on the Patriots’ failed Fanene signing, with Fanene able to keep $2.5 million of the original signing bonus and the Patriots receiving a credit on their 2013 salary cap.

    1b. As part of the Patriots’ grievance against Fanene, the NFL Players Association filed a grievance against the club seeking the removal of team doctor Thomas Gill (details here). It wouldn’t be accurate to say that the grievance has been dropped, according to sources, but a resolution is in the works. The issue of team doctors providing care that puts players first, which in some cases could mean the team’s best interests aren’t being served, is something the NFL Players Association has always had on its radar, most recently from earlier this year with the San Diego Chargers. Look for more on this hot-button issue in the days and weeks to come as the NFL Players Association keeps it in the spotlight.
