    have to assume if that person was free they would get the sex change. Seems cruel to force the person to live as man. I'm not crazy about paying for it however prisoners are not supposed to be punished for anything other than their crime. Still I don't think many are happy about paying for it.

    Maybe s/he should have thought about that before s/he whacked his/her wife?

    I would have less of an issue with this if it was a surgery to save someone's life.

    But a totally elective surgery?

    Seems like a slap to the face of MA taxpayers.

    I'm with you ... however the law is supposed to be against cruel and unusual punishment. I hate hearing this about as much as the next person. But to force this woman to live in a man's body I'm thinking crosses into the cruel department.

    Tough call there Drewski - as always my opinion is divided between what I would do and what I think should be done ... everyday of my life I have this problem. :ugh:

    But would this fall under "cruel and unusual punishment"?

    I guess I just always applied that line to ensuring prisoners aren't abused or mistreated while in confinement. Maybe this is a modern manifestation of it in the eyes of the law, but I fail to see where that line is drawn.

    It's not the same line as it was for me or others in the 70's and 80's that's for sure.

    In the 70's the prisoners would just cut the junk off the guy and leave it at that - deal done.

    I don't think it's punishment, though.

    First question is whether it's elective -- I believe it is, though I won't call it cosmetic.

    if it's elective, then he could have had the surgery at some point in the past, but for whatever reason, he didn't have it.

    Now, if prison policy is to permit elective surgeries, fine, he should be able to get this -- but he should be paying for it, just like inmates should pay for any elective surgeries (if they're able to get them at all)

    I don't see it under any circumstance, he lived his life as a man prior to incarceration.. now that he is incarcerated, he has a lot of time on his hands so he is all of a sudden transgendered?? Self induced freakiness....

    If he were on the street would have to pay for it himself, as medical insurance would probably not pay for it..

    Correctional officers have a difficult job, don't make it more difficult..

    Just checked out this case, do not remember it..

    I've done a lot of work in prisons, wiring video equipment and installing cameras. Women's prisons are less violent, more laid back and easier to do your time.

    That's all this is about.

    Chop his junk off, sew it up, give him a bag and ship his sorry ass to administrative segregation.

    Heck, I'm a lesbian trapped in a man's body, but somehow I deal with it every single day!

    Hopefully tax dollars aren't used to fund sex changes for anyone on the outside too. Guess that will change once the new health care kicks in, huh?

    So does that mean I can get a facelift on the public's dime soon?


    Way.....WAYYYY too much attention being given to all these little needs. Born the wrong sex? Cry me a river......

    I said it probably falls under that ... not that I think that.

    I mean the judge has to have some legal basis and I was trying to figure out what it would be.

    Easy now RW ... I'd lop it off for free to save a buck.
