    You need to take a basic civics course.. of course we are just ending an era where the "Constitution was a goddam piece of paper?"

    This guy is another f..ing activist judge appointed by George Herbert Bush.. and is a conservative.. see a trend here.

    This is one of those cases Obama inherited from Bush. As he has already said in other cases, until the DOJ can wrap their hands around a particular issue, they are adopting the same legal view of the Bush administration. But, in this case, rather than moving forward with the Bush administration position, they appear to be consciously doing nothing.

    My guess is that the Obama administration is selectively planning to lose certain cases in order to shape their policy. For instance, losing this case, could help them shape their warrantless wiretapping policies in ways that are more consistent with American values.
