    Maybe they should have read it before they passed it.

    Does this mean that laws no longer have to actually reflect the "intent"? Boy, that will make it a lot easier to get laws related to highly contentious issues passed, won't it?

    Lost in the stories yesterday was the states who refuse to have exchanges....the theory is politically they will be forced to have them. But if enough of them refuse it will be interesting going forward. The ACA will either have to be rewritten and voted upon or hello single payer. I do not see them winning this at the SCOTUS level.

    It's a 2,000 page bill with ambiguous verbiage in one subsection.

    The real question is whether you think it appropriate to potentially rescind health insurance for millions of people because a select few refuse to use common sense.

    Judge Davis put it well in the 4th circuit ruling:

    I am not arguing with you about the need for health insurance, I am asking a serious question about the law. If the contingency provision is outlined somewhere in there, how did this even become an issue that was treated seriously by anyone?

    I have no idea how evidence is presented to the Supreme Court or these lower courts but this definitely is a problems for the obamans. It doesn't appear to be a "typo" anymore but a deliberate part of the plan to pressure states into setting up exchanges.

    Don't make a mistake on your tax return or any financial reporting, though, because we will incarcerate you (after scaring your children when we show up with a swat team).

    I'm a little late to the party, but is this guy now saying what he said was mistaken? He explained it in detail, and even gave the rationale around it. i.e. without a state exchange, residents would pay for the bill but not get the benefits.
