Court rules part of Jefferson raid unconstitutional

    Although Jefferson certainly deserves his comeuppance, the Constitutional issues are interesting. I think our founders wanted to protect the Congress from intimidation by the Executive. That intimidation could come disguised as a just cause, but also have political aims.

    The Justice Department did not immediately return messages seeking comment on the decision. Officials have said they took extraordinary steps, including using an FBI "filter team" not involved in the case to review the congressional documents. Government attorneys said the Constitution was not intended to shield lawmakers from prosecution for political corruption.

    The court was not convinced. It said the Constitution insists that lawmakers must be free from any intrusion into their congressional duties. Such intrusion, even by a filter team, "may therefore chill the exchange of views with respect to legislative activity," the court held.

    The case has cut across political party lines. Former House Speakers Newt Gingrich, a Republican, and Thomas Foley, a Democrat, filed legal documents opposing the raid, along with former House Minority Leader Bob Michel, a Republican.

    Conservative groups Judicial Watch and the Washington Legal Foundation were joined by the liberal Citizens for Responsibility and Ethics in Washington in supporting the legality of the raid.

    Leave it to some Carter or Clinton appointed judge to toss the law (and common sense) into the hopper and start making their own witch's brew. Kind of like instant soup: hot and steamy, but with a bad after-taste.

    What law, Fog? Are you talking about the separation of powers, which to some is so dear that they're willing to possibly jeopardize the case against Jefferson (though that's not clear from this ruling)? It is a tricky issue, and sometimes the courts, when so compelled, come down on the side of the Constitution, not on the side of common sense, and that means that Congress must then create new laws.

    Good to see that the Constitution is a not a "goddam piece of paper". Need to some fact check and stop assuming, a quick check of the three judges involved in this decision shows something different:

    Chief Judge Ginsberg appointed by Ronald Reagan
    Judge Henderson appointed by George H. Bush
    Judge Rogers appointed by Bill Clinton.


    But Fog, betcha, that Ginsberg is Allans secret son from a tryst about 70 years ago.. thus he has inbred liberal leanings.. and is a closet pornographer.

    So you got lucky (I didn't bother to check your links, so I'm taking you at your word they're good) and these weren't all Democrat appointments. Some guys have also made full-court nothing-but-nets, but I wouldn't put big money on that happening very often. Happens once in a blue moon.

    Your comments reflect that you assume too much.. gotta remember the Constitution is not a "goddam piece of paper". It ain't about pissing, it is what it is the truth.

    Are you consciously trying to be cute, or are you just so into one-upmanship that you will create straw men at every opportunity.

    YOU introduced the "Constitution as worthless" theme; no one else did. Pure straw, nothing else.

    I made the assumption that a Democrat-appointed judge had ruled to vindicate an obvious crook, on technical grounds. "If the glove don't fit, you must acquit", kind of thing.

    So, if anyone was betting on whether it was a Dem-appointed or Repub-appointed judge who would try to pull this kind of crap, most reasonable people would admit such a thing would most likely be done by the Dem -- as long as the accused is a Dem, that is.

    Tell you what, Puj. Let's imagine you have kids some day: they get to the age when they are faced with the decision about using drugs and getting into sex. You gonna tell them to just do whatever they feel like doing??

    I don't know a single parent in the world who would do such a thing and still feel that they are doing their jobs as parents.

    I did not introduce the "Constitution is a goddamned piece of paper", just echoing George and some of his documented comments. Your assumptions are still erroneous, but then we expect the same old blah, blah, blah.. situational ethics.. do not understand your religion as you change more than the wind. Reminds me of the if it feels good it is ok..

    In case you forgot GWB is the President, one of the duties of the president is to set the tone for the Country.. when he said the "Constitution is just a goddamned piece of paper", many believed this and blindly followed.

    You are the one who invited rebuke on this thread, when you assumed that the "activist judges" were appointed by Carter and Clinton.. do you remember all that now. Keep changing the subject, pure and simple you are a self serving fraud who leads a double life.. one on the corner in Vilnius and one here where your true colors show.

    So, Clinton was responsible for only one of the judges .... in this instance. The fact is, such a ruling of "unconstitutionality" in this case of the "frozen 90 grand" in Democrat Congressman Jefferson's refrigerator has all the earmarks of a liberal law-changing Democrat-appointed judge.

    And you and everyone else knows it. Which is why you are so desperate to spin this around and away from what everybody already knows is true.
