    I don't think it would be a good idea to drop to the level of these ridiculous Jets fans, but in looking over my notes I think we could make an excellent case for defamation of character. I plan on reading the lawsuit when it is made available, but from what I've read it seems highly frivolous. For example, I believe it is alleging that the illegal video taping has taken place over a period of years, whereas the Commisioner's statement said specifically there was only evidence of the one game from this year. I am certain there are more examples like this which demonstrate how ridiculous this suit is.

    I am a law student, so I cannot file any suit on my own, but I would be more than happy to work with anyone on this board who is a lawyer and bang out some work to see if this is possible, if other PatsFans think it is a good idea.

    Sorry, I think this was a bit of a knee-jerk reaction at being disgusted by this suit. In thinking about it a little more, it is obvious that we cannot file a countersuit on behalf of the Pats or our coach. I was just thinking that there must be some sort of legal remedy available. They are fans suing our team, so I guess I was thinking along those lines for a countersuit. I don't think we should stoop to their level. I am positive this suit will be dismissed anyways.

    Jets are pathetic. Get another nonsense suit ready for when you don't make the playoffs, morons. :rocker:

    Allegations contained in court documents are for obvious reasons privileged. You can't sue someone for defamation because you disagree with their allegations, even if they have no basis in fact.

    This countersuit would have a whole lot more basis in the law than the original.

    Methinks what little credibility Florio had is gone once this is all over if he continues to pump this story like its legit.

    Watch, the judge selected to preside over the case will be related somehow to the Poston brothers (or insert anyone here that BB has pissed off).

    You're funnin' ...
    but in the States the legal system has decayed to where one only files a suit
    in a jurisdiction that you believe favors your type of claim
    ... and where you've plotted the case assignments so that you can almost
    select the judge you'd prefer to preside.

    "Advance scouting" the judiciary, so to speak.

    I concur. We need to streamline this judicial process and get the wheels in motion for this countersuit.

    Though it occurred in 1996, the Pats would have had a much better case against the Jets along with anyone who bought tickets for the NE/GB Superbowl. I'm sure most of us remember very well the issues purportedly surrounding the Jets pursuit of our HC as we were preparing to play a Superbowl.

    Goodell said that the Spygate incident had no effect on the Pats/Rats game, but I think what the Jets were purported to have done had a huge effect on the Superbowl, and that was a much bigger game on a much larger stage.

    As I recall, the Pats had actual phone records showing that the Jets had been contacting Parcells before the game and soon after the game Parcells was gone to the Jets as HC and the Pats were compensated with draft choices due to the Jets tampering. I don't recall if there was any penalty at all leveled on the Jets for having an impact on the outcome of the Superbowl.

    If the Pats STHs had wanted to file a lawsuit against the Jets on that case I suspect they would have a much better chance of winning than the Jets STHs have.

    It's too bad that we can't respond to the Jets in kind, but they only go to Superbowls as spectators.

    I say file a nuisance suit against Reno Mahe for claiming we are in possession of rings that rightly belong to the Eagles. This in effect accuses us of stealing the property, which of course although having a great deal of monetary value, has even more symbolic value.

    Mahe alleges without proof that the Pats have stolen the Eagles' property. It strikes me that this is defamation (though I'm not a lawyer.)

    I mean, I can't go stand on a soap box and scream "Bill Polian stole my Subaru," can I? Why is a super bowl ring any different?

    Actually, the best countersuit would be to have some Patsfans lawyers seek to put every team on the stand, including Mangini, to determine how many other teams are employing the same type of "cheating"

    We know now that a Colts assistant has been implicated in the same videotaping - Jimmy Johnson has also named a Chiefs assistant... and of course Mangini himself who effectively admits he was doing this in the past too - so if the suit against the Patriots for committing fraud holds any water it only makes sense to determine if the Jets fans and other fans have a much larger case against all other teams.

    Frankly I'd welcome having all 31 other teams come clean about this the way the Patriots did - everyone's acting a little bit overly righteous these days... in other words, me thinks they dost protest too much...

    Of course, the main difference here is that in the case of other teams and coaches, the media takes a "innocent until proven guilty" approach, ignorning Johnson's implication of the Colts and Chiefs - whereas in the case of the Patriots its "guilty until proven innocent".
