What are the chances either Parker or Chin change their ruling in the event of an en banc rehearing and support Brady?

Not really hopeful about Chin since I was stunned to hear him say that the case against Brady deflating the balls was compelling, as IMO only trolls and haters can look at the evidence and find it compelling against Brady, fair minded observers seem to see the case against Brady as very weak.

it all depends on if they decide to read any of the actual evidence, like most of America, they just ASSuMed that Brady was guilty. I think the conduct of the NFL and the fact that Brady is innocent should be the focus of the next hearing.

Exactly, I can't believe guys in these positions are influenced by external factors or have an agenda, they just didn't do a lot of homework. In Judge Berman's rule he emphasised "independent investigation" all over his ruling, that should have been enough for these guys to understand where the dirt was, he already gave the homework ready for them and they flat out ignored.
 
If this was so important to the NFLPA, why didn't they hire this guy to start with? That being said I am glad they continue to fight this. I am not expecting a successful resolution for our side, but you never know.
 
I think there is a slight chance he has the 7. Katzmann, Cabranes, Pooler, Lynch, Lohier, Carney and Droney

I was his waiter for a couple years at a restaurant he went to daily. Granted, this was 2 decades ago BUT--he is from Connecticut.

And hopefully more a Patriots than a Giants fan.

After the oral argument it sounded like Chin and Parker read the NY Post :rolleyes:

It sounded like kessler was too proud to hand the reins over to someone else.

Unfortunately kessler pulled a papelbon and gave up the lead in the top of the ninth.
 

 


This was essentially their argument about the CBA: rules are rules and if you agree to them and later on don't like them then tough

I think there is a lot of 20/20 hindsight with the criticism over keeping Kessler for the appeal. I can't recall one single word from anyone saying they should replace Kessler prior to the appeal itself.

I see him a the QB who won the first round. You don't bench a winning quarterback, so they gave him the starter job for the appeal. But he lost the appeal, so now he's benched.

Both kessler and steffen johnson work for the same firm. I wonder if johnson was brought in as a "consultant" only, i.e., kessler called the final shots.

The guy has Fed appeal and SCOTUS experience up the wa-zoo

New Haven. Allegiances were split growing up.

By the way, the Connecticut River runs east of Old Saybrook which is close to the Rhody state line, so... I would not use the river as an example. I would instead think of old New England town greens. Milford/Stratford is about the first of the New England towns. Up to Bridgeport and north to Danbury, there's a heavy New York presence. Outside of that, things are split at the boundaries. Then more New England east.

I dunna know. We can debate all day on this....

I dont see how Old Say is near the RI state line.....?

With that said, Old Say is a Sox/Yanks split.

New London is 70/30 Pats.

Hartford is 60/40 Pats

New Britain/Bristol was a A/AA home of the Sox so there is a stronghold there but dying off.

I'll get a bit more granular and say that E/W of 91 is NY/NE

With that said my dad grew up in Boston and hes a Giants fan :rolleyes:
 
I haven't got through this whole thread, but I had to say I doubt Brady invites the typical left leaning sympathies for the "working class". True, they may be considering the greater picture of their ruling in the organized labour context, but I feel like this case is a wash for politics. You have a multi-million dollar employee/brand vs. a multi-billion dollar brand here.

I don't even think it is management versus labor as far as the judges are concerned. It's "arbitrators should have a lot of power" versus "arbitrators have to stay within certain bounds of fairness."

What we have is "labor" suing to overturn an arbitration ruling based on fundamental fairness, but it could just have easily been from an industry where management was suing to overturn an arbitration ruling based on fundamental fairness.
