Bar Owner Suing DirecTV Over Pats-Giants Game
 
Last Saturday, over 35 million were able to watch the Patriots clinch a perfect regular season record. But not everyone was happy with the broadcast decision.
Christopher Biechele, manager of Cheers Sports Bar & Grill, claims he lost business when the Pats-Giants game was shown over the on-air networks. Originally, the matchup was only going to air on the NFL Network, until the league decided to simulcast the contest on CBS & NBC.

It's not his game to move.

The station that had the original exclusive has a case. This is frivilous.

This is not DirecTV's decision, it is the NFL. If he sues, he would have to go after the NFL, not DirecTV.

Incorrect. He doesn't have standing to sue the NFL because he has no contractual relationship with them. He can sue Direct TV and then Direct TV can join the NFL as a codefendant.

I think a lot will have to do with how Directv advertised the product when he bought it....

If signed up for directv two years ago he doesn't have a case.

If he signed up in September because he got an letter that said something to the effect of....

"Sign up for Directv, and get NFLN. This year 12 great game Thursday and Saturday night game will only be on the NFLN. Over 70% of the football fans in the area do not have NFLN and will be wanting to watch it somewhere. Your bar could be that somewhere. Get Directtv and see your business grow."

Then he has a pretty good false advertising claim.

I thought one of the Boston networks was going to broadcast the game on an over the air channel. Not sure which one. But, I'm sure I read that leading up to the game.
