Burress gets indicted, Pierce is in the clear

NEW YORK -- Plaxico Burress has been indicted by a Manhattan grand jury investigating a gun charge against the former New York Giants wide receiver, New York City prosecutors said.

The indictment handed down Monday charges the 31-year-old Burress with two counts of criminal possession of a weapon and one count of reckless endangerment.

He better hope his celebrity is good enough to win over the jury at trial, he's got a date with jail if he doesn't.

Guess he can kiss this year goodbye, no way he plays this year.

The tabloids here have been all over this, generally buying Pierce's story, except for The Post (a "newspaper" only in the most generous use of that term), which has editorialized that it's difficult to accept that Pierce didn't know that it was just the teensiest, tiniest, little bit wrong to take the gun back to New Jersey. But, i think the DA decided that the point he wanted to make was on possession and I guess Pierce was convincing in his argument that he was confused and under stress after the events of the night...a not unreasonable position IMO. Also, the Mara's really stood behind Pierce.

As for Burress, he's been offered, according to media reports, a two year prison deal but he only wants to serve one. So, it looks like a game of chicken with both sides trying to determine the likelihood that Burress can get a jury that will nullify or hang.
