Moss Won't Have to Go to Court Monday

Sharpstein will appear in Broward County Circuit Court on Monday and request a delay in a scheduled hearing to determine whether a permanent restraining order should be issued against Moss.

"I'm going to go in and ask the judge to put it off," Sharpstein told ESPN.com. "We'll agree to extend the temporary order until we can deal with a permanent order, and we'll ask to put it off until a date after the Super Bowl. The judge will set a hearing [date] and Randy will appear. Then we'll deal with the substance, which is bulls---."

Wouldn't you be just fine with a permanent restraining order from someone trying to extort hals a million dollars from you?

Why would Randy ever want to go near her again?

It's not that he would ever want to go near her, but that he wants to defend his name and reputation. If they just grant this woman a permanent restraining order with no argument from Moss or his legal team, that kind of looks bad on his part.

I think it's pretty obvious who's telling the truth here, but if Randy goes to court, defends himself, and the restraining order gets denied, then I think that will shut up any doubters. However, if he doesn't defend himself and just takes the restraining order, then that will leave the door open for haters to assume guilt based on the fact that he didn't defend himself in court. I think this is more about slamming that door shut than anything....

Plus, the perm. restraining order means, apparently, you have to get rid of any firearms you own... To hell with that. Fight, if for anything, your rights, ya know?
 
It's possible to accidentally violate a restraining order. I wouldn't want to worry about anything permanent like that.

And of course the case was continued. Moss will be a LOT less busy in a few weeks than he is now. :)
 
Didn't his accuser not pay her rent for months straight and repeatedly try to stay her eviction? There's no possible way she's getting a perm restraining order against him or making it out of a court with anything but legal fees. And how is she affording legal representation anyway? Whole thing stinks! Almost think some no-name attorney is preying in on her 1. to make a name for himself, 2. he wanted a crack at a quick 50k for himself if he could've extorted randy for well over six figures.

No. If you agree to the restraining order without challenging the facts, she can use it against you in a later civil action for $$ damages. When they first reported that he was just going to agree to the restraining order, I wanted to call his legal team and say, "That's bad strategy!" Plus, if she gets nervous about having to testify, it may bring her to the table to take short dollars and end the whole thing. Then his legal team should tell Randy to stay away from this woman, whether a final restraining order is issued or not. (My guess is shortly before the 2nd hearing takes place, a private settlement will be announced.) Before everyone jumps in and says he shouldn't pay her anything, think about what he has to lose (his reputation, whether he battered her or not - she threatened to come out with drug/alcohol abuse stuff) vs. what a few thousand dollars means to him. His attys will encourage him to "make a business decision," and pay her something to make her go away.

So if there is a restraining order and she shows up at the team's hotel or around Gillette etc.. he could be in violation?

That could be like reverse stalking.

THis is SOOOO such a media created story that it makes me sick. I cringe whenever the media talks about it. Talk about a tempest in a teapot, this ISN'T even a criminal matter. Something the media so easily ignores. RIght now this is a merely DISPUTE between "old friends" But framed in that light, it would hardly be newsworthy. :rolleyesL

It makes me sick - an unbiased media source DOCUMENTS 935 overt lies by the administration leading up to the Iraq war, and all that gets on the news is Brady's boot, hairplug-gate, Romo's breakup....and Moss' court date. :rolleyes:

Ken - you know I love you but please keep this stuff on the political forum.

As for Moss, I think he'll be scoring a couple of times next Sunday.
