This tells me they really do plan to go to SCOTUS when the time comes. As hard as it is to believe. There aren't many other valid reasons why you would bring in Ted Olson.

So does this mean temporarily the suspension is "off" again? I think Florio said it was an automatic stay when you were seeking the en banc review.

Technically, this is only a request for an extension of time. Brady has until next Friday 5/6 to request the en banc review. They're requesting an extension until 5/23 to make that decision.

Oh no, Brady is going to keep fighting. That's conduct detrimental to the league and Goodell can suspend him forever because he's the Fuhrer.
 
If they try to get it to the SC, does anyone know how long the SC decides whether to take the case ? As slow as the legal system is, I am wondering if the entire 2016 season could be played before the SC even decides not to take it, if that's the choice.

I would guess they are trying to buy time for Olsen to review everything and build a case for review. I think they will grant eh banc review given the impact the ruling could have on so many players.

My bad, eh banc review is in Canada, it's en banc here.

I didn't realize he meant the Judges on the appeal. I thought he was talking about something else.

I was merely quoting an old obscure snickers commercial about the kc chefs and also noting frame gate is far from done. My wife will tell you if I have a bad joke to make, even if I'm the only one who will get it, I will make it. Sorry. :)

I wish this move had been made before the appeal rather than now, but better late than never.

Question for people who are well-versed in this stuff: even if the SC decides to hear this case, what are the odds that the result is anything other than a 4-4 split along purely ideological lines? Seems like it would be a shock for any of Roberts/Alito/Thomas/Kennedy to depart from the anti-labor party line and rule and decide in Brady's favor. Seems like en banc is still the best shot at success, however unlikely it may be.

This assumes, of course, that Clinton wins the presidency and a Republican-dominated senate continues to stonewall any attempt at a SC appointment.

I was trying to make this same point with some morons with whom I am accqainted who were going on & on about Brady needing t just stfu & stfd and take his suspension. Decisions like these which, by their nature make waves in their specific area,also send ripples far far out across the water and have an effect upon all sorts of areas of law which involve contracts of any sort. Every union and collective bargaining unit ought to be paying attention to this case because, in one way or another, the final ruling once all appeals are exhausted, will definitely be precedence-setting.

Well, I assume he'd be included if/when they decide to go through the en banc request. I think the only reason people realized he was added to the legal team is because he's the lead name in this extension request -- it's his signature that appears, he shows up first in the names, etc.

This brief isn't the appeal, it is a request for a 2 week extension to file the appeal, which is currently due Friday, May 6.

They talk about how this will be a wide-ranging ruling, they need time to get all interested parties together for discussions, they need a little more time for other stuff, and that this isn't being done simply as a stalling technique.

Can't remember if it was someone else who posted this before on here, or elsewhere, but this is fitting.
 
But it still a long shot to get an en banc hearing at the 2nd circuit. Theodore olson should have been brought in earlier. They have to convince 6 other judges for an en banc hearing in a circuit that does not like to touch arbitration results. Just because olson is on board does not mean the court will grant one.

En banc review is probably an exercise in futility even if they allow it (hope I'm pleasantly surprised to be wrong about that).

Let's hope this new counsel has enough juice to get cert. and a stay on the suspension.
 
He's in clement's league. I've been saying that they should have done something like this since the day clement was announced.
