I agree, I dont see us going out west and beating a very good Cardinals team with our backup QB... not unless we have a running game and our defense plays lights out

It's not impossible, but that's a tall order for Jimmy G.. those 2 division games are MUST WINS at home
 
Katzmann, like Berman, is an intelligent being with thought for the law. The other two are just corrupt idiots.

Katzmann like Berman actually gave this case some careful thought. The other two judges basically said CBA and get it off our table.
 
Very Kafkaesque. The court states it can only rule on procedure, not facts and then pounds the NFLPA and Brady for not arguing the facts...WTF.....

That truly is bizarre stuff.

*Which, even if they were ruling on the facts of the case, wouldn't make any sense.
 
No it isn't. Goodell used the signed footballs thing to turn into
Brady “knew about, approved of, consented to, and provided inducements and rewards in support of a scheme by which with Mr. Jastremski's support, Mr. McNally tampered with the game balls.”
I thought there was a text between McNally and Jastremski saying that "Brady gives u nothing" wouldn't that squash that argument?
 
That why this will be a lost season. People aren't seeing the big picture. Hogan and Bennett will have next to zero chemistry with TB in game situation. They will be lucky to go 10-6 this season because of that. If the have an injury to Gronk or Edelman I will drop that further. This was the goal of the NFL which is why the maddening game plans and play at junctures last season were so terrible. That was the one best lash chance to win it all again. Maybe not the last, but the best last chance.

Here is the decision, if there isn't already a link to it.

I would expect a motion by Brady's attorneys to stay the decision and request for a rehearing en banc (full court) given the 2-1 decision with the Chief Judge dissenting. If that rehearing motion is granted (and the dissenting opinion helps in that regard), then this falls back to a holding position as before the decision today and likely would not be decided until after the season. In effect, Brady would not be suspended until the full court decides the case (there are plenty of other judges on that court, so the 2 here may not present a huge issue).

I'm a little surprised the majority peremptorily flushed the remaining issues and directed that the award (suspension) be confirmed. In any event, it isn't over yet.

As for offering percentages on the decision on appeal, nobody really knows what three judges are going to do on a purely legal question. I didn't love the basis for Bermann's decision (it was a little less mainstream than the typical arbitration decision), but I expected the appeals court would let him decide the remaining issues he expressly did not decide in sending the case back to him.

NY judges. We lucked out that Berman wasn't biased. These other judges obviously are.

This is why the NFL acted first to get the case in NY before the union was able to appeal.
And Kessler and the Union fell right into their trap by filing their appeal in Minnesota, which had nothing to do with the case, instead of Massachusetts.
 
4 liberals on the court, 4 conservatives. It may leave the 2nd circuit ruling in place. But by the time the court gets around to the case there could be a new appointment. Do i really have to root for hillary to win this?

A Sanders appointment would be very union friendly

A Trump appointment would be the beginning of Armageddon, but at least he's a friend of Brady so that could potentially work in our favor..

I'm really not sure what you'd get with Hillary.. probably whoever Goldman Sachs wants to be appointed, which I doubt would be very union friendly
 
I get that but saying that the Arbiter can make mistakes of facts or law when putting out an award is going a step far don't you agree ? Again, it is not so much about the Brady case for me but this sentence is crazy.
This goes farther, beyond mistakes of fact.

it will depend on what the Pats have in Garoppolo........it's not like the Cards defense is shut down......Gabbert and Bridewater threw for over 300 against them as did Bradford...it's a winnable game, but 3-1 sounds more reasonable

I just arrived in Boston, sat down in a restaurant, and the first thing I see on the TV is Brady is suspended again. F***ing fantastic.
 
I'm finished with the NFL.
I said the same thing last year, decided to come back because Brady won in court. Different story this year, will not be watching or going to any games. The NFL can go **** themselves and if Goodell gets hit by a bus, I will hold a party.
 
It is astonishing that not all of the issues raised in Berman's decision were addressed directly. Astonishing because they all affect the outcome. It's really hard to fathom.

I would move to have the entire Second Circuit hear the case en banc.

Katzmann actually uses that to support the point that Goodell exceeded his authority and violated procedural fairness by adding allegations not raised in the Wells Report. The others just don't care.
 
Kraft should forfeit the away games while Brady is suspended..
you know while I know it won't happen, I like this idea!! think of how much money the NFL would lose.
