Next stop would be Supreme Court via writ of certiorari, but a petition for certiorari seeks Supreme Court review not as a matter of right but as a matter of judicial discretion.

On top of that, they get hundreds of requests every year, and pick and choose just a handful, and this, AFAIK, would be the first sports-related case, and if picked, might cause backlash because there are far more pressing issues for the SC to deal with than something to do with sports.

To be fair, this has to do with a whole lot more than sports too. This case is fundamentally about the standards of arbitration in the workplace, which affects a ton of Americans. I don't think you're wrong, in that a whole lot of people would interpret this as being a case about sports, but if the SC cares more about impact than PR, then this could very well be a case worth taking on.
 
The more and more i think about it the 2nd circuit's opinion could be a good grounds for an en banc hearing. They effectively said "goodell can do whatever he wants" since the players agreed to the CBA

I think this decision makes a defamation suit more likely. It may be the only way Brady can clear his name in the court of public opinion, outside NE....among the great unwashed illiterate masses....
I don't know about this but really wish he would since it looks like he will be serving the suspension.
 
Daniel Wallach was on Zo and Bertrand. He indicated the Peterson case could have bearing on this case being heard by the SC. If Peterson wins, it would be a split between the appeals courts which would make Brady's case more likely to be heard by the SC. Time to root for Peterson.
 
Damn... the 2nd Circuit basically cut Berman's balls off on this one.

In reversing Judge Berman, however, the Second Circuit opted to rule on all open issues,blocking any further effort by Judge Berman to defeat the suspension.

I don't know if it would have made a difference (probably not), but Berman should have taken another day or two and ruled on all the issues.

After Berman's ruling, it seemed like those issues were always nice to have in reserve - The appeals court rules against Berman, it goes back to him and he can rule on the ones that were "held back." I never heard about the possibility of the appeals court reversing everything, but here we are.

Worst case we go 12-4 Brady hasn't lost more than 12 games since 2009 so I fully expect brady to go 12-0, we are gonna win at least 2 of the games with Jimmy G because with all our weapons on offense there's no way Jimmy sucks that bad
 
Frightening. Our court system, power, the general view of the patriots....speechless. Disgusted.
 
Ultimate FU to Goodell...sit Brady entire season, make a mockery of reg season, tank every game and get #1 pick in '17 draft

Worst case we go 12-4 Brady hasn't lost more than 12 games since 2009 so I fully expect brady to go 12-0, we are gonna win at least 2 of the games with Jimmy G because with all our weapons on offense there's no way Jimmy sucks that bad

I think the Pats will be fine. I expect them to go at least 2-2 in Brady's absence, likely 3-1 and possibly 4-0. Honestly, that's not even the issue for me. The issue is that I'm just finding it increasingly impossible to even stomach the NFL. I already settled on sticking around with mixed feelings until Brady and Belichick are gone. Now I'm not even sure I can do that.

Oh I don't know... Maybe Krafty could've fought it in court, made a big stink in the court of public opinion... I don't know, anything but bend over, grab his ankles and gladly take a gigantic phallus in the arse....
 
I read that opinion as the Court saying "We don't want to deal with this. Your sloppy CBA has given us an excuse not to and we're taking it. Buh-bye."

A legitimate Court would focus in on the 'appropriate action' that underlies this whole disaster. The CBA has to be interpreted as being valid only if the parties act in good faith. The issue is that Goodell didn't. To me, that makes his 'actions' in-'appropriate' and, thus, outside the CBA.

As long as Roger Jets Goodell is commish, the NFL is truly ****ed
 
The court system in this country is fu**ed.

Thats why they did it in New York.. because at that 2nd circuit level, it's all billionaire buddy buddy poker games and barbecues, which the nfl is heavily involved in

They aren't even going to allow Berman to rule on the other issues he left open... I don't get how this is even possible, but like most things in our government I'm appalled.. similar to when I found out what a "super delegate" was during these primaries.. because I couldn't understand how a candidate could win 9 states in a row and still have less delegates in all 9 states

It's all incredibly depressing

How would they know this? They made no effort to look at any QBs in the draft...their draft board will inevitably change now.
