Patriots fans sue NFL for Draft Picks

Instead of wasting resources filing a frivolous suit verses the NFL, the guy should set up a GoFundMe account with all donated money used to help locate Robert Kraft's spine
Save Goodell's turkey neck! Every year the thing gets worse, look at his most recent picture, his head looks like one long tube connected to his body between the shoulders. He's going to start tripping on it soon.

What would be great is if they could get an injunction against the NFL from holding the draft! They could surely show that if the draft was allowed to proceed before their case (which will get tossed on standing, as many before me has said) is adjudicated, the harm done would be irreparable.

maybe they get a die hard pats fan judge who lets the case go forward and issue the injunction, it would at the very least, cause the NFL to answer for itself and maybe think upon their sins.

Not a lawyer, but posting link to Wikipedia page showing requirements for preliminary injunction.

Preliminary injunction - Wikipedia, the free encyclopedia

Must meet all requirements. The first one - strong likelihood of success on the merits of the case. Not a chance would an injunction be issued.

You know who could get an injunction? Bend-Over Bob Kraft if he sued on the grounds of fraud/breach of contract. The "do not sue" league clause doesn't hold if the contract is already invalid because of fundamental violations. But Bob cares too much about his 31 buddies and Roger "he's doing a great job!" Goodell to actually do that.

Not a great look for our fanbase to be perfectly honest.

I still think it's not out of the question that we hear about Tom and the Dorito Dinks filing a defamation suit someday. Then we'll get the answers we are looking for. This isn't the way to do that.

I think even Bob must realize by now that the other owners don't exactly share the sentiment that they are "buddies" with him.

Yeah we look like idiots. A lawsuit could have been OK, but this wasn't well executed.

From Deadspin (and they generally agree with us that DeflateGate was BS):

Haha, I mean... I'm not exactly shocked to find out he's a crap lawyer, but hitting a puppy?

Can't remember the last time Jets fans had to complain about the NFL wrongfully taking away the team's first round pick

To be fair to the NFL, it's probably not worth the trouble. We usually do a pretty good job of wasting our 1st pick all by ourselves.

It just makes me sick, all those millions of dollars wasted on that hollow human being.

I'm fine with that. Who wants a WWE football league, anyway?
Why are you here? If the NFL is so terrible, why not watch soccer or curling?

The NFL is the best sports product in the world. Of course, there will always be whiners.

Goodell really needs to be featured in Bernie's ad campaigns. The greatest evidence available of any problems with the capitalist system.

This is nothing more than crass commercialism for Carey, the atty, in the dog eat dog of lawyerism, any publicity is good publicity...

Prepare for the commercials... "Carey means business"!!!!

You're absolutely correct that it was collectively bargained, etc, etc, and there's no case here.

However it my little world, "the other 31" are engaging in unfair labor practices against the New England Patriots. Now, I know they can't sue, etc, etc. but it would be nice if the big picture could be seen that the jealousy of 31 teams has resulted in the taking of valuable assets of a competitor.

There's nothing affiliated with labor involved here though. Bob Kraft doesn't work for the other 31 owners, they're all partners in the league. It's basically a club. And if every other member of a club decides that they don't like you, and have a legal (by the rules of the club) way to stick it to you, it is not the court's job to start micromanaging how that goes down.

Nonsense. It's for the good of the children, for the good of player safety, and also the never to be overlooked, Integrity.

Integrity, it's contagious, outrageous and the feel-good feeling of that yum-yum-yummy NFL. It's good, good, good. Yay! Integrity!

Thanks, Rog, here's another $40 million! Yay! Let's go play in China! It's only a day away! Yay!

This is insulting dumb.

Slow your roll, Vector. The Plaintiff in the case caption is "New England Patriots Fans", which means you. Stop beating yourself up.:)

On the upside, the documents may be bounced as a matter of form before reaching the merits given the failure to actually list the individual plaintiffs in interest in the civil cover sheet and case caption (they are listed within the body of the Complaint with a non-legal entity (business or person) in the case caption). A possible opportunity to get off the ride before it gets really ugly. It is good to see Mr. Carey did not include himself as a party, so I doubt he will be paying any bills that may be assessed on the fans he named as parties after garnering his 15 minutes of fame that have already been realized. As a professed "super fan", I am sure he would not abandon these non-lawyer fans and leave them to pay the tab on their own.

He has appeared in three federal cases as an attorney of record to date. Two in Maine (one was his own disciplinary proceeding), one a State case procedurally dragged to federal court (voluntarily dismissed by him) and now this. His legal brief is about 50% a cut and paste of the Wikipedia Deflategate article (without attribution of course and didn't even bother to copy the citations into the body of the text), with a legal argument inferior in quality to many non-attorney briefs I have read over the years.

This may well be a very expensive lesson for the fans involved if this case is bounced as frivolous, as it may well be, because they may have to pay for the other side preparing briefs and showing up at a restraining order hearing (they and their associates will actually spend many hours preparing for briefs and hearings at $500 - $1,000+ per hour). Welcome to the wonderful word of joint and several liability, and the billing rates of multiple New York attorneys affordable only to billionaire defendants, for which you may have to foot the bill as a result of this. A little added salt in the wounds of your poor NFL experiences. I am betting their tab may not be limited to the GoFundMe payments if this goes forward.

The idea of suing makes us all look bad.

The idiot who did it and the way it was handled makes us all look even worse.

I don't mind suing, the embarrassing part is for "emotional distress" for faaahck sake

Hey -- I'm emotionally distressed by it. Well, vexed more than distressed, but in the same ballpark.
