NFL Appeal oral arguments thread

Like when almost everyone said that Berman had no choice but to rule for the nfl??
And that people out here were absolutely, 100% positive that he was a Jets fan?

"Funny thing about the law, it can be quite flexible."

Line from the movie RocknRolla. In my experience, this line rings very true.

Isn't that pretty close to what Parker said at the Appeal? Didn't he say something like that Arbitration can get "down and dirty."

When will we get the verdict ? I am tired of waiting ...

The point is, you really can't predict what a judge(s) are going to do. The laws are very often murky enough that the judge can rationalize any ruling he wants to make.

Even if the law and the facts are crystal clear, that isn't going to deter a judge from ruling whatever way he wants. Especially not in NY. Trust me, I know.

I read today that the expedited ruling we're expecting will still take 6-8 weeks.

Forget the verdict, when are we going to get a freaking transcript?

More like come back at 1 am, hes posting them page by page...

Still thank god it's out.

And also see @IanPGunn's commentary on the pages as @WALLACHLEGAL tweets them out.

A number of people are noticing how the judges go very easy on Clement, especially in contrast to how they hammered Kessler.

*Sigh*

Well the transcript pages for Kessler aren't posted yet... maybe they won't be so bad.

The unfortunate fact of the matter is that so many of these things - including the Brady case - likely comes down to luck of the draw. There are certainly judges that would have ruled in favor of the NFL had they been selected instead of Berman, and there are certainly combinations of these current judges which spell victory and other combinations that spell defeat.

Thanks for posting that. Not to get everyone in a tizzy, but these 2 stood out to me:

Ian Gunn ‏@IanPGunn

Relevant to note here as @WALLACHLEGAL goes through this section, how much leeway Clement is getting to explain position

Ian Gunn ‏@IanPGunn
He's really not getting hard questions & getting time to say what he wants in response. Not tough oral argument, esp for SCOTUS pro like him

I read somewhere, probably earlier in this thread or in one of the links that was posted, that Clement spoke for 28 minutes. If he got "easier" questions and was allowed to make his point compared to Kessler, my instinct would be that that's a bad sign. Of course, it may not be. We haven't seen the Kessler pages yet and we don't know how the judge will rule.

I call bull ****. Brady got 2 judges who are pro labor, but unfortunately are likely Jet fans.

Oh for ****s sakes I can't stand it. STOP ASSUMING THAT EVERY SINGLE GOD DAMN PERSON WHO HAS A PROBLEM WITH THE PATRIOTS IS A JETS FAN. CHRIST it makes you look like a goddamn baby. Did these judges even grow up in New York? Did they go to school in New York? I doubt it. But obviously they must be Jets fans right?

The Clemente half has more softballs than a, um...softball factory. How the hell were we told for 6 months that none of the actual case would come up and then BANG they are essentially retrying the case from the standpoint that Brady is very very guilty? Honestly, how is that fair? This is our justice system? Freaking joke, man.

I'm surprised they are waiting. I don't know why they didn't just say "Overturned, Mr Brady is a cheater". Because they are all thinking it, it jumps off the pages and quotes.

For what it's worth: apparently the judge called Brady's explanation about the cell phone "incredible" not "ridiculous" like was originally quoted....

Well, Chin was born in Hong Kong but, other than that, I think all three judges live, work, and were educated in or near NYC. I don't know how much experience you have with NYC but (1) pretty much everyone who lives/works there is batsh*t crazy narcissist; (2) they are seething with jealous resentment toward Boston sports teams and (3) outside of maybe Chicago and DC, NYC is second to none when comes to government corruption.

Not a fan of the second season of Better Call Kessler so far...

The big muckety muck attorneys in NY tend to know the NY judges pretty well. If these judges are NY sports fans (and I wouldn't drop dead from shock to learn that they were), Kessler would probably know this but would know better than to call them out about it publicly.
