NFL Appeal oral arguments thread

Judges decide the case and one of them writes the opinion.

Once the opinion comes out, the loser will decide whether or not to appeal.
Oh wow, I thought with everyone saying this may take 5-6 months before a decision there was going to be more happening. Thanks for the info!

As reports are almost unanimous that things went better for the league than for Brady today, let us all give a big **** YOU to Krafty Bob for bending over and grabbing his ankles for the "good of the 32" **** you Bob....

I'll admit I know nothing about this process......so what happens next?

We wait for the Second Circuit to issue its decision. Regardless of its decision, the losing party has the right to seek a rehearing en banc (before all of the judges of the Second Circuit). The Court would be more likely (but not guaranteed) to allow this if the initial decision is 2-1. If it is reheard en banc, then we wait even longer. If the Court rules for Brady, this is effectively done (I highly doubt the Supreme Court would grant certiorari here, and there is no right of appeal to the Supreme Court for this case). If the NFL wins, the Second Circuit could: (1) decide it all right away, reinstate Brady's suspension, and call it a day; (2) remand to Judge Berman for further proceedings; or (3) order another arbitration.

I just don't know how anyone can argue against Berman's points. How can you say there was prior notice?

Where will the decision be published?

Here? Guess I better bookmark this and refresh... lol

Everyone recall that Berman did not rule on one item even as the other 3 were so overwhelming. Kick it all back and still can get tossed on that 4th item Berman passed on.

There were actually three other claims that Berman left undecided.

You can't argue against that. I think the NFL's position is that it doesn't matter whether he had notice or not.

Little newsflash for you: Kraft couldn't have done **** to stop what is going on with Brady.. nfl set out to suspend him from the beginning.

At this point, there's only one thing we can do... it's time to bring in the big guns.

On the "Decisions" page of the Second Circuit's website, they update with new decisions when they are released. The parties (and other attorneys with accounts) can check the actual case docket. There's a 99% chance that you'll learn of the decision from other sources before it comes out, but you'd find it here: Decisions.

"Who told you to destroy the cell phone?!!"

Why would Kessler say that? Not liking this
Impossible to tell out of context, but he's only human and may have lost his cool...which these guys are paid big bucks not to do....
